The following law may apply to a Montana tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Montana. They include rules drivers, their employers, and owners of trucks must follow.

The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi trucks) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

MONTANA TRUCKING LAW

Montana tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of the highlights are listed below.

2. MONTANA SEMI TRUCK DRIVER QUALIFICATIONS:

Both Federal and Montana state safety regulations require that Montana drivers of semi trucks (tractor trailers) meet certain qualifications. Each Montana driver employed by a motor carrier (the trucking company) is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years. Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of A Montana tractor trailer (semi truck) driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of an Montana driver is at least 18 years old. (MONT. ADMIN. R. 23.3.505)
iii. (i) however, a person who is at least 16 years of age and has a minimum of 12 months driving experience may be issued a type 2 endorsement with a "B" classification, restricted to hauling goods and property only within a 150 mile radius of his/her home or place of employment;

(ii) A person who possesses the above "underage" endorsement may have the restrictions imposed due to age removed on or after his/her 18th birthday by completing a driving examination for the type and class of endorsement desired.

(b) can safely operate the type of commercial motor vehicle driven;

(c) can determine whether the cargo he/she transports (including baggage in a passenger carrying vehicle) has been properly placed, distributed, and secured in or on the commercial motor vehicle driven;

(d) is familiar with methods and procedures for securing cargo in or on the commercial motor vehicle driven;

(e) is physically able to meet the requirements of ARM 23.3.504(1) and (2) or, if unable to meet those requirements, meets the requirements of ARM 23.3.506 and complies with ARM 23.3.507;

(f) has been issued a currently valid Montana driver's license;

(g) is not otherwise ineligible to operate a motor vehicle;

(h) has successfully completed the required driving examination (or presented a certificate of employment/ experience in the case of an exchange or conversion);

(i) has, in the case of a new applicant, successfully completed a written examination appropriate to the class or type of endorsement applied for.

(j) certifies that he/she operates solely in intrastate activities and that he/she is not subject to 49 C.F.R., part 391. (MONT. ADMIN. R. 23.3.505)

b. Language:
i. English: Montana semi truck drivers must be able to speak, understand, and converse in the English language.
ii. Montana tractor trailer (semi truck) drivers must understand traffic signs.
iii. Montana semi truck drivers must be able to make records and reports in English. (49 CFR 391.11(b)(2))

c. Operation of Montana Motor Carrier (Employer):
i. Experience or training qualifies Montana tractor trailer (semi truck) drivers to safely operate A Montana semi truck (tractor trailer) or Montana commercial vehicle. (49 CFR § 391.13)
ii. Montana semi truck drivers must have the physical capability to operate motor carrier. (49 CFR § 391.41)
1. (1) A person may not be issued, nor may he/she retain a type 2 endorsement, unless he/she:

(a) has no loss of a foot, a leg, a hand, or an arm; no impairment of a hand or finger which interferes with prehension or power grasping; no arm, foot, leg, or limb impairment which interferes with the ability to perform normal tasks associated with operating a motor vehicle; or he/she has been granted a federal waiver or exemption or has demonstrated through a road test that the loss or impairment of a limb or extremity does not significantly affect his/her driving ability as determined by the examiner who conducts the test;

(b) has no established medical history or clinical diagnosis of diabetes mellitus currently requiring the use of insulin for control, unless he/she supplies a statement from his/her physician which indicates that he/she has not suffered from any loss of consciousness or control from the condition for the preceding 3 years, and that the condition is currently controlled;

(c) has no current clinical diagnosis of myocardial infarction, angina pectoris, coronary insufficiency, thrombosis, or any other cardiovascular disease of a variety known to be accompanied by syncope, dyspnea, collapse, or congestive cardiac failure, with any episode within the last 12 months;

(d) has no established medical history or clinical diagnosis of a respiratory dysfunction likely to interfere with his/her ability to control and drive a motor vehicle safely;

(e) has no current clinical diagnosis of high blood pressure likely to interfere with his/her ability to operate a motor vehicle safely;

(f) has no established medical history or clinical diagnosis of rheumatic, arthritic, orthopedic, muscular, or vascular disease which interferes with his/her ability to control and operate a motor vehicle safely;

(g) has no established medical history or clinical diagnosis of epilepsy or any other condition which is likely to cause loss of consciousness or any loss of ability to control a motor vehicle unless he/she has net had any episode of loss of consciousness or control within the preceding 5 years as certified by his/her physician;

(h) has no mental, nervous, organic, or functional disease or psychiatric disorder likely to interfere with his/ her ability to drive a motor vehicle safely;

(i) has distant visual acuity of at least 20/40 (Snellen) in each eye without corrective lenses, or visual acuity separately corrected in one or both eyes to 20/40 (Snellen) or better with corrective lenses. Applicants with binocular vision shall have a field vision of at least 70 in the horizontal meridian in each eye, and monocular applicants shall have a field vision of at least 70 temporal and 30 nasal;

(j) first perceives a forced whispered voice in the better ear at not less than 5 feet with or without the use of a hearing aid or, if tested by use of an audiometric device, does not have an average hearing loss in the better ear greater than 50 decibels at 500 Hz, 1,000 Hz, and 2,000 Hz with or without a hearing aid when the audiometric device is calibrated to American National Standard Z24.5-1951;

(k) does not use an amphetamine, narcotic, or any habit-forming drug; and

(l) has no current clinical diagnosis of alcoholism. (MONT. ADMIN. R. 23.3.506)
iii. Montana tractor trailer (semi truck) drivers are required to reduce speed and to take into consideration bad weather conditions. A Montana semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Montana driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Montana License:
i. Montana semi truck drivers must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Montana (49 CFR § 383.23(a)(2))
iii. The semi truck driver has successfully completed Montana road test (49 CFR § 383.23(a))

e. Montana Certifications:
i. Has any and all certifications required by Montana employer / Montana motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate a Montana semi truck / Montana motor carrier  (49 CFR § 391.15)

f. Montana Driver Responsibility:
a. Hours of Service
i. No motor carrier shall permit or require any driver used by it to drive a property-carrying commercial motor vehicle, nor shall any such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or
(2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property-carrying driver complies with the provisions of Sec. 395.1(o).
(b) No motor carrier shall permit or require a driver of a property-carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after--
(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
(c)(1) Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or
(2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

ii. For the purpose of 49 CFR part 395, drivers of utility service vehicles are exempt from the hours of service requirements consistent with P.L. 108-199. (MONT. ADMIN. R. 18.8.1502)

iii. For the purpose of 49 CFR 395.1(k), the planting and harvesting seasons during which transportation of agricultural commodities or farm supplies for agricultural purposes is conducted shall be deemed to run from January 1 through December 31 of each year. (MONT. ADMIN. R. 18.8.1502)

iv. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

b. Truck Driver Logs
i. A Montana tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Montana employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations.  (49 CFR § 395.8)

ii. For the purpose of 49 CFR 395.8, a person exempted from 49 CFR 395.3 pursuant to the exclusion set forth in 49 CFR 395.1(k) must keep a daily record of the number of hours worked. No record of duty status must be maintained. The format of the daily record may be determined by the record keeper, so long as the format includes a provision for entry of hours worked by calendar day. The daily record must be retained for a period of six months from initial entry date. Payroll records or time sheets may be used for this purpose, if they are updated on a daily basis. (MONT. ADMIN. R. 18.8.1502)

iii. Driver Logs: 49 CFR § 395.8 involve A Montana tractor trailer (semi truck) driver making a record of his duty status. A Montana driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iv. Because of technology, the Montana semi truck driver log is often kept by an on-board recording device. The log indicates when the Montana driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Montana motor carrier is responsible if the tractor trailer (semi truck) driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether a Montana driver keeps two sets of logs or books, so that he or she could drive longer than they are allowed to drive by Montana law.

v. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

vi. A Montana motor carrier (the trucking company) is responsible and required to fashion or schedule their Montana truck driver’s runs and routes in a way that would allow Montana drivers to complete them without violating any speed limits or Hours-of-Service violations. 

vii. Montana tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

c. Alcohol and Controlled Substances
i. Alcohol and drivers of Montana tractor trailers (semi trucks): A trucker cannot have any alcohol in his or her system at all while driving a tractor trailer (semi truck). This, of course, includes driving, but also when Montana drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. Alcohol is not tolerated whatsoever, which is different from drivers of cars, certain vans, and motorcycles that have alcohol in their system up to certain limits, and still may be able to legally drive. The rules involving Montana truck drivers are extremely strict. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

d. Truck Equipment & Repair
i. A driver of A Montana tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

ii. This section of the Federal Motor Carrier Safety Regulations includes brakes to the tractor, brakes to the trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities in were a result from a collision involving a large truck.
2. It is important for regulations to be followed so that violations do not result in a Montana semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iii. The Montana tractor trailer (semi truck) driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

iv. A Montana semi truck driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)

v. Restrictions as to tire equipment -- particular tires, chains, or traction equipment

(1)  A solid rubber tire on a vehicle must have rubber on its entire traction surface at least 1 inch thick above the edge of the flange of the entire periphery.

(2)  A person may not operate or move on a highway a motor vehicle, trailer, or semitrailer having a metal tire in contact with the roadway.

(3)  A tire on a vehicle moved on a highway may not have on its periphery a block, stud, flange, cleat, spike, or other protuberance of a material other than rubber that projects beyond the tread of the traction surface of the tire, except that it is permissible to use farm machinery with tires having protuberances that will not injure the highway. It is also permissible to use tire chains of reasonable proportions or pneumatic tires, the traction surfaces of which have been embedded with material, such as wood, wire, plastic or metal, that may not protrude more than one-sixteenth of an inch beyond the tire tread or that are clearly marked by the manufacturer on the sidewall "all season m&s" (or "all season mud and snow"), upon a vehicle when required for safety because of snow, ice, or other conditions tending to cause a vehicle to skid. Except as provided in subsection (4), the use of pneumatic tires embedded as provided in this section is permitted only between October 1 and May 31 of each year, except that one of those tires may be used for a spare in case of tire failure. School buses equipped with such embedded pneumatic tires may operate from August 15 through the following June 15.

(4)  Pneumatic tires that feature an embedded block, stud, flange, cleat, spike, or other protuberance that is retractable may be used at any time of the year. However, the protuberance may not be engaged or extended other than between October 1 and May 31 of each year on roads that do not contain ice or snow.

(5)  The department of transportation and local authorities, as defined in 61-8-102, in their respective jurisdictions may in their discretion issue special permits authorizing the operation upon a highway of farm tractors or other farm machinery or of traction engines or tractors having movable tracks with transverse corrugations upon the periphery of the movable tracks, the operation of which upon the highway would otherwise be prohibited under this section.

(6)  If the department of transportation determines at any time that dangerous or unsafe conditions on a highway require particular tires, tire chains, or traction equipment for vehicles in addition to or beyond the ordinary pneumatic rubber tires, the department may establish the following recommendations or requirements with respect to the use of the equipment for all vehicles using the highway:

(a)  chains or other approved traction devices recommended for driver wheels;

(b)  chains or other approved traction devices required for driver wheels; or

(c)  chains required for driver wheels.

(7)  Equipment required by subsection (6)(b) or (6)(c) must conform to rules established by the department of justice.

(8)  The department of transportation shall place and maintain signs and other traffic control devices on a highway designated under subsection (6) that indicate the tire, tire chain, or traction equipment recommendation or requirement determined for vehicles. The signs or traffic control devices may not prohibit the use of pneumatic tires embedded as provided in subsection (3) between October 1 and May 31 of each year, but when the department of transportation determines that chains are required and that no other traction equipment will suffice, the requirement is applicable to tires on driver wheels of one axle, as defined in 61-10-104, of a vehicle, including embedded tires. The signs or traffic control devices may differentiate in recommendations or requirements for four-wheel-drive vehicles in gear. (Mont. Code Anno., § 61-9-406)

e. Intrastate Regulations:
i. With respect to 49 CFR 385.21, an intrastate motor carrier must complete a "Motor Carrier Identification Report" (form MCS-150) at the following times:

1. before the carrier begins operation;
2. and every 24 months thereafter, in accordance with the schedule in 49 CFR 390.19. (MONT. ADMIN. R. 18.8.1502)

ii. For the purpose of 49 CFR 390.21, the department will assign a United States department of transportation (USDOT) number to each intrastate motor carrier and that number, in addition to the name or trade name of the motor carrier, must be marked on each self-propelled commercial motor vehicle operated by the carrier in the same manner as is required of a federally issued USDOT number.
1. The motor carrier is required to mark each vehicle subject to these regulations with "USDOT," the number assigned and the state abbreviation "MT."
2. All CMVs that are part of an intrastate motor carrier's existing fleet as of April 23, 2004 and that are marked with a motor vehicle identification (MVI) number must be converted to the carrier's USDOT number on or before September 30, 2005. (MONT. ADMIN. R. 18.8.1502)

f. Disqualifications of Driver:

i. Montana motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. (49 CFR § 391.15)
ii. Some disqualifying offenses of Montana semi truck drivers include (but are not limited to):
1. Driving with a revoked or suspended license
2. Driving while under the influence of alcohol or drugs
3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)
4. Committing a felony with the use of a commercial motor vehicle (semi truck)
5. Speeding, or Reckless Driving
6. Improper and/or erratic traffic lane changes
7. Following another vehicle too closely when driving the semi truck
8. Railroad crossing violations when driving the semi truck

3. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Montana semi truck drivers:

No additional routes have been federally designated; under State law STAA-dimensioned commercial vehicles may legally operate on all highways which, prior to June 1, 1991, were designated as Federal-aid primary highways.

4. FALLEN CARGO:  Many Montana semi truck accidents occur because cargo has fallen from the Montana truck’s trailer and injured another Montana motorist. Often when Montana semi truck accidents occur because of fallen cargo it is a result of the Montana driver not securing the cargo properly. There are certain rules that Montana semi truck drivers must follow when securing cargo.

5. LAW: Montana adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Montana.

6. MONTANA IS AN AT-FAULT STATE.

i. Montana is an at-fault state: This means that when you are injured in a Montana semi truck accident, the law of negligence will govern your claim. The at-fault driver is responsible for your injuries.
ii. Uninsured Motorist Coverage: If you are injured in a Montana semi truck accident, by an at-fault driver who does not have any insurance, or adequate insurance, to cover your claim, uninsured or underinsured motorist coverage may protect you in this situation.
1. Uninsured Motorist: UIM Coverage may protect you if you are involved in a Montana semi truck accident with an at-fault driver who does not have ANY insurance to cover your damages.
2. Underinsured Motorist: UIM Coverage may protect you if you are involved in a Montana semi truck accident with an at-fault driver who does not have ADEQUATE insurance to cover your damages.
iii. Statute of Limitations: 3 years
1. If you wish to commence a suit to recover damages for injuries resulting from your Montana semi truck crash, you must do so within 3 years from the date of your Montana semi truck accident. (Mont. Code Anno., § 27-2-204)
