The following law may apply to a Washington tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Washington. They include rules drivers, their employers, and owners of trucks must follow.

The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi trucks) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

 

WASHINGTON TRUCKING LAW

 

Washington tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of the highlights are listed below.

2. WASHINGTON SEMI TRUCK DRIVER QUALIFICATIONS:

Both Federal and Washington state safety regulations require that Washington drivers of semi trucks (tractor trailers) meet certain qualifications. Each Washington driver employed by a motor carrier (the trucking company) is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years. Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of a Washington tractor trailer (semi truck) driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of a Washington driver is at least 18 years old. (WAC § 446-65-010)
b. Language:
i. English: Washington semi truck drivers must be able to speak, understand, and converse in the English language.
ii. Washington tractor trailer (semi truck) drivers must understand traffic signs.
iii. Washington semi truck drivers must be able to make records and reports in English. (49 CFR 391.11(b)(2))

c. Operation of Washington Motor Carrier (Employer):
i. Experience or training qualifies Washington tractor trailer (semi truck) drivers to safely operate A Washington semi truck (tractor trailer) or Washington commercial vehicle. (49 CFR § 391.13)

ii. Washington semi truck drivers must have the physical capability to operate motor carrier. (49 CFR § 391.41)

1. The department may waive the skills test and the requirement for completion of a course of instruction in the operation of a commercial motor vehicle specified in this section for a commercial driver's license applicant who meets the requirements of 49 C.F.R. part 383.77. (Rev. Code Wash. (ARCW) § 46.25.060)


2. (1) If the medical examiner or physician finds any physical condition listed in Title 49 CFR 391.41 (b)(1) through (13) that is likely to interfere with the driver's ability to operate or control a motor vehicle safely, it shall be the responsibility of the driver to immediately forward a copy of the driver's medical examination to the Department of Licensing, Responsibility Division, Medical Section, P.O. Box 9030, Olympia, WA 98507-9030. Upon receipt of the medical examination, the department of licensing will review and evaluate the driver's physical qualifications to operate the class of motor vehicle the person intends to drive.


(2) The department of licensing shall send a notice of determination to the driver. A department of licensing clearance notification shall be sufficient cause for the medical examiner to issue a medical examiner's certificate.


(3) A failure by the driver to furnish a copy of the medical examination to the department of licensing as required above shall result in no clearance action being taken by the department of licensing. (WAC 446-65-020)

iii. Washington tractor trailer (semi truck) drivers are required to reduce speed and to take into consideration bad weather conditions. A Washington semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Washington driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Washington License:
i. Washington semi truck drivers must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Washington (49 CFR § 383.23(a)(2))
iii. The semi truck driver has successfully completed Washington road test (49 CFR § 383.23(a))
iv. Drivers of commercial motor vehicles shall obtain a commercial driver's license as required under this chapter. Except when driving under a commercial driver's instruction permit and a valid automobile or classified license and accompanied by the holder of a commercial driver's license valid for the vehicle being driven, no person may drive a commercial motor vehicle unless the person holds and is in immediate possession of a commercial driver's license and applicable endorsements valid for the vehicle they are driving. However, this requirement does not apply to any person:
1. Who is the operator of a farm vehicle, and the vehicle is:
a. Controlled and operated by a farmer;
b. Used to transport either agricultural products, which in this section include Christmas trees and wood products harvested from private tree farms and transported by vehicles weighing no more than forty thousand pounds licensed gross vehicle weight, farm machinery, farm supplies, or any combination of those materials to or from a farm;
c. Not used in the operations of a common or contract motor carrier; and
d. Used within one hundred fifty miles of the person's farm; or
2. Who is a firefighter or law enforcement officer operating emergency equipment, and:
a. The firefighter or law enforcement officer has successfully completed a driver training course approved by the director; and
b. The firefighter or law enforcement officer carries a certificate attesting to the successful completion of the approved training course; or
c. Who is operating a recreational vehicle for noncommercial purposes. As used in this section, "recreational vehicle" includes a vehicle towing a horse trailer for a noncommercial purpose; or
d. Who is operating a commercial motor vehicle for military purposes. This exemption is applicable to active duty military personnel; members of the military reserves; members of the national guard on active duty, including personnel on full-time national guard duty, personnel on part-time national guard training, and national guard military technicians (civilians who are required to wear military uniforms); and active duty United States coast guard personnel. This exception is not applicable to United States reserve technicians. (Rev. Code Wash. (ARCW) § 46.25.050)
v. No person may drive a commercial motor vehicle while his or her driving privilege is suspended, revoked, or canceled, while subject to disqualification, or in violation of an out-of-service order. Violations of this subsection shall be punished in the same way as violations of RCW 46.20.342(1). (Rev. Code Wash. (ARCW) § 46.25.050)
vi. The department shall to the extent possible enter into reciprocity agreements with adjoining states to allow the waivers described in subsection (1) of this section to apply to drivers holding commercial driver's licenses from those adjoining states. (Rev. Code Wash. (ARCW) § 46.25.050)

e. Washington Certifications:
i. Has any and all certifications required by Washington employer / Washington motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate a Washington semi truck / Washington motor carrier  (49 CFR § 391.15)

f. Washington Driver Responsibility:
i. Washington as adopted Part 395 Hours of Service of drivers:
a. No motor carrier shall permit or require any driver used by it to drive a property-carrying commercial motor vehicle, nor shall any such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or
(2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property-carrying driver complies with the provisions of Sec. 395.1(o).
b. No motor carrier shall permit or require a driver of a property-carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after--
(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
(c)(1) Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or
(2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

ii. Washington has adopted Part 395 Hours of Service for drivers: Except if a company has:
a. Drivers of commercial motor vehicle of any size, hauling logs from the point of production or driving in dump truck operations in intrastate commerce; or
b. Operators of intrastate property-carrying commercial motor vehicles that do not require a commercial drivers license to operate.
iii. They are exempt from the requirements of CFR 395.3 (maximum driving time) and CFR 395.8 (record of duty status) and ineligible to use the provisions of CFR 395.1 (e)(1), (g) and (o) provided that:
a. The driver must:
i.  Operate within a one hundred air-mile radius of the location where the driver reports to work and the driver must return to the work reporting location at the end of each duty tour;
ii.  Have at least ten consecutive hours off duty separating each on-duty period;
iii.  Not drive:
1. More than twelve hours following at least ten hours off duty; or
2. After the fourteenth hour after coming on duty on at least five days of any period of seven consecutive days; and
3. After the sixteenth hour after coming on duty on no more than two days of any period of seven consecutive days; and
4. After having been on duty for eighty hours in seven consecutive days if the employing motor carrier does not operate commercial motor vehicle every day of the week; or
5. After having been on duty for ninety hours in eight consecutive days if the employing motor carrier operates commercial motor vehicle every day of the week; in any period of seven or eight consecutive days may end with the beginning of any off-duty period of twenty-four or more consecutive hours. (WAC § 446-65-010)

iv. As provided in Part 395, exemption for agricultural transporters, the harvest dates are defined as starting February 1 and ending November 30 of each year.
a. Agricultural operations exceptions:
i. Agricultural operations transporting agricultural products other than Class 2 material (Compressed Gases), over roads, other than the National System of Interstate Defense Highways, between fields of the same farm, is excepted from Part 397 when:
1.  The agricultural product is transported by a farmer who is an intrastate private motor carrier.
2. The movement of the agricultural product conforms to all other laws in effect on or before July 1, 1998, and 49 CFR 173.24, 173.24a, and 173.24b.
ii. The transportation of an agricultural product to or from a farm within one hundred fifty miles of the farm, is excepted from the requirements of 49 CFR Part 172 subpart G (emergency response information) and H (training requirements) when:
1. The agricultural product is transported by a farmer who is an intrastate private motor carrier;
2. The total amount of agricultural product being transported on a single vehicle does not exceed:
i. Sixteen thousand ninety-four pounds of ammonium nitrate fertilizer properly classed as Division 5.1, PGIII, in bulk packaging; or
ii. Five hundred two gallons for liquids or gases, or five thousand seventy pounds for solids, of any other agricultural product;
iii. The packaging conforms to the requirements of state law and is specifically authorized for transportation of the agricultural product by state law and such state law has been in effect on or before July 1, 1998; and
iv. Each person having any responsibility for transporting the agricultural product or preparing the agricultural product for shipment has been instructed in the applicable requirements of 49 CFR adopted in this section. (WAC § 446-65-010)
v. Formulated liquid agricultural products in specification packaging of fifty-eight gallon capacity or less, with closures manifolded to a closed mixing system and equipped with a positive dry disconnect device, may be transported by a private motor carrier between a final distribution point and an ultimate point of application or for loading aboard an airplane for aerial application.

vi. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

g. Truck Driver Logs
i. A Washington tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Washington employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations.  (49 CFR § 395.8)

ii. Driver Logs: 49 CFR § 395.8 involve A Washington tractor trailer (semi truck) driver making a record of his duty status. A Washington driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iii. The motor carrier that employs the driver must maintain and retain for a period of twelve months accurate and true time recordings showing:

1. The time the driver reports for duty each day;
2. The total number of hours the driver is on duty each day;
3. The total number of hours the driver drives each day;
4. The time the driver is released from duty each day; and
5. The total time the driver is driving and on duty for the preceding seven days. (WAC § 446-65-010)


iv. Because of technology, the Washington semi truck driver log is often kept by an on-board recording device. The log indicates when the Washington driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Washington motor carrier is responsible if the tractor trailer (semi truck) driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether a Washington driver keeps two sets of logs or books, so that he or she could drive longer than they are allowed to drive by Washington law.

v. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

vi. A Washington motor carrier (the trucking company) is responsible and required to fashion or schedule their Washington truck driver’s runs and routes in a way that would allow Washington drivers to complete them without violating any speed limits or Hours-of-Service violations. 

vii. Washington tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

h. Alcohol and Controlled Substances
i. Alcohol and drivers of Washington tractor trailers (semi trucks): A trucker cannot have any alcohol in his or her system at all while driving a tractor trailer (semi truck). This, of course, includes driving, but also when Washington drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. Alcohol is not tolerated whatsoever, which is different from drivers of cars, certain vans, and motorcycles that have alcohol in their system up to certain limits, and still may be able to legally drive. The rules involving Washington truck drivers are extremely strict. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

i. Truck Equipment & Repair
i. A driver of A Washington tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

iii. This section of the Federal Motor Carrier Safety Regulations includes brakes to the tractor, brakes to the trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities in were a result from a collision involving a large truck.
2. It is important for regulations to be followed so that violations do not result in a Washington semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iv. Tire Restrictions
1. It is unlawful to operate a vehicle upon the public highways of this state unless it is completely equipped with pneumatic rubber tires except vehicles equipped with temporary-use spare tires that meet federal standards that are installed and used in accordance with the manufacturer's instructions.
2. No tire on a vehicle moved on a highway may have on its periphery any block, flange, cleat, or spike or any other protuberance of any material other than rubber which projects beyond the tread of the traction surface of the tire, except that it is permissible to use farm machinery equipped with pneumatic tires or solid rubber tracks having protuberances that will not injure the highway, and except also that it is permissible to use tire chains or metal studs imbedded within the tire of reasonable proportions and of a type conforming to rules adopted by the state patrol, upon any vehicle when required for safety because of snow, ice, or other conditions tending to cause a vehicle to skid. It is unlawful to use metal studs imbedded within the tire between April 1st and November 1st, except that a vehicle may be equipped year-round with tires that have retractable studs if: (a) The studs retract pneumatically or mechanically to below the wear bar of the tire when not in use; and (b) the retractable studs are engaged only between November 1st and April 1st. Retractable studs may be made of metal or other material and are not subject to the lightweight stud weight requirements under RCW 46.04.272. The state department of transportation may, from time to time, determine additional periods in which the use of tires with metal studs imbedded therein is lawful.
3. The state department of transportation and local authorities in their respective jurisdictions may issue special permits authorizing the operation upon a highway of traction engines or tractors having movable tracks with transverse corrugations upon the periphery of the movable tracks or farm tractors or other farm machinery, the operation of which upon a highway would otherwise be prohibited under this section.
4. Tires with metal studs imbedded therein may be used between November 1st and April 1st upon school buses and fire department vehicles, any law or regulation to the contrary notwithstanding. (Rev. Code Wash. (ARCW) § 46.37.420)

v. Safety Chains: It shall be unlawful to operate any vehicle upon the public highways of this state without having the load thereon securely fastened and protected by safety chains or other device. The chief of the Washington state patrol is hereby authorized to adopt and enforce reasonable rules and regulations as to what shall constitute adequate and safe chains or other devices for the fastening and protection of loads upon vehicles. (Rev. Code Wash. (ARCW) § 46.37.490)

vi. The Washington tractor trailer (semi truck) driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

vii. A Washington semi truck driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)


j. Intrastate Regulations
i. Part 391 Qualification of drivers is adopted, provided that 49 CFR 391 subpart D (Tests), and E (Physical Qualifications and Examinations) do not apply to motor carriers operating vehicles with gross vehicle weight rating between 10,001 lbs. and 26,000 lbs. operating intrastate, and not used to transport hazardous materials in a quantity requiring placarding. (WAC § 446-65-010)
ii. A common carrier, contract carrier, or temporary carrier shall not operate for the transportation of property for compensation in this state without first obtaining from the commission a permit for such operation. (Rev. Code Wash. (ARCW) § 81.80.070)
iii. (1) All motor vehicles, other than those exempt under subsection (2) of this section, must display a permanent marking identifying the name or number, or both, on each side of the power units. For a motor vehicle that is a common or contract carrier under permit by the commission as described in subsection (3)(a) of this section, a private carrier under subsection (4) of this section, or a leased carrier as described in subsection (5) of this section, any required identification that is added, modified, or renewed after September 1, 1991, must be displayed on the driver and passenger doors of the power unit. The identification must be in a clearly legible style with letters no less than three inches high and in a color contrasting with the surrounding body panel.
(2) This section does not apply to (a) vehicles exempt under RCW 81.80.040, and (b) vehicles operated by private carriers that singly or in combination are less than thirty-six thousand pounds gross vehicle weight.
(3) If the motor vehicle is operated as (a) a common or contract carrier under a permit by the commission, the identification must contain the name of the permittee, or business name, and the permit number, or (b) a common or contract carrier holding both intrastate and interstate authority, the identification may be either the commission permit number or the federal vehicle marking requirement established by the United States department of transportation for interstate motor carriers.
(4) If the motor vehicle is a private carrier, the identification must contain the name and address of either the business operating the vehicle or the registered owner.
(5) If the motor vehicle is operated under lease, the vehicle must display either permanent markings or placards on the driver and passenger doors of the power unit. A motor vehicle under lease (a) that is operated as a common or contract carrier under permit by the commission must display identification as provided in subsection (3)(a) of this section, and (b) that is operated as a private carrier must display identification as provided in subsection (4) of this section. (Rev. Code Wash. (ARCW) § 81.80.305)

k. Disqualifications of Driver:

i. Washington motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. (49 CFR § 391.15)
ii. Some disqualifying offenses of Washington semi truck drivers include (but are not limited to):
1. Driving with a revoked or suspended license
2. Driving while under the influence of alcohol or drugs
3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)
4. Committing a felony with the use of a commercial motor vehicle (semi truck)
5. Speeding, or Reckless Driving
6. Improper and/or erratic traffic lane changes
7. Following another vehicle too closely when driving the semi truck
8. Railroad crossing violations when driving the semi truck

3. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Washington semi truck drivers:

No additional routes have been federally designated; under State law STAA-dimensioned commercial vehicles may legally operate on all highways which, prior to June 1, 1991, were designated as Federal-aid primary highways.

4. FALLEN CARGO:  Many Washington semi truck accidents occur because cargo has fallen from the Washington truck’s trailer and injured another Washington motorist. Often when Washington semi truck accidents occur because of fallen cargo it is a result of the Washington driver not securing the cargo properly. There are certain rules that Washington semi truck drivers must follow when securing cargo.

5. LAW: Washington adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Washington.

6. WASHINGTON IS AN AT-FAULT STATE.

i. Washington is an At-Fault state: This means that the law of negligence governs Washington motor vehicle accidents. The person who is found to be “at fault” for your Washington semi truck accident can be held accountable for your injuries and damages resulting from your Washington semi truck crash.
ii. Statute of Limitations: 3 years
1. If you wish to commence a suit to recover damages for injuries resulting from your Washington semi truck crash, you must do so within 3 years from the date of your Washington semi truck accident. (Rev. Code Wash. (ARCW) § 4.16.080)
