NATIONAL TRUCKING LAW

The following law may apply to a Indiana tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Indiana. They include rules drivers, their employers, and owners of trucks must follow. The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi truck) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

INDIANA TRUCKING LAW

Indiana tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of  the highlights are listed below.

2. INDIANA SEMI TRUCK DRIVER QUALIFICATIONS:

Both federal and Indiana state safety regulations require that Indiana drivers of semi trucks (tractor trailers) meet certain qualifications. Each Indiana driver employed by a motor carrier is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years (49 CFR 391.51). Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of an Indiana driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of an Indiana driver is at least 18 years old. (Burns Ind. Code Ann. § 8-2.1-24-18(f))

b. Language:
i. English: Indiana semi truck driver must be able to speak, understand, and converse in the English language.
ii. Indiana driver must understand traffic signs.
iii. Indiana driver must be able to make records and reports in English.

c. Operation of Indiana Motor Carrier (Employer):
i. Experience or training qualifies Indiana driver to safely operate a Indiana semi truck or Indiana commercial vehicle. (49 CFR § 391.13)
ii. Has physical capability to operate motor carrier (49 CFR § 391.41)
a. A person hired before September 1, 1985, who operates a motor vehicle intrastate incidentally to the person's normal employment duties and who is not employed as a chauffeur (as defined in IC 9-13-2-21(a)) is exempt from 49 CFR 391 (Qualification of Drivers) as incorporated by this section. (Burns Ind. Code Ann. § 8-2.1-24-18(e))
b. Notwithstanding subsection (a) or (b), the following provisions of 49 CFR do not apply to private carriers of property operated only in intrastate commerce or any carriers of property operated only in intrastate commerce while employed in construction or construction related service:
(1) Subpart 391.41(b)(3) as it applies to physical qualifications of a driver who has been diagnosed as an insulin dependent diabetic, if the driver has applied for and been granted an intrastate medical waiver by the bureau of motor vehicles pursuant to this subsection. The same standards and the following procedures shall apply for this waiver whether or not the driver is required to hold a commercial driver's license. An application for the waiver shall be submitted by the driver and completed and signed by a certified endocrinologist or the driver's treating physician attesting that the driver:
(A) is not otherwise physically disqualified under Subpart 391.41 to operate a motor vehicle, whether or not any additional disqualifying condition results from the diabetic condition, and is not likely to suffer any diminution in driving ability due to the driver's diabetic condition;
(B) is free of severe hypoglycemia or hypoglycemia unawareness and has had less than one (1) documented, symptomatic hypoglycemic reaction per month;
(C) has demonstrated the ability and willingness to properly monitor and manage the driver's diabetic condition;
(D) has agreed to and, to the endocrinologist's or treating physician's knowledge, has carried a source of rapidly absorbable glucose at all times while driving a motor vehicle, has self monitored blood glucose levels one (1) hour before driving and at least once every four (4) hours while driving or on duty before driving using a portable glucose monitoring device equipped with a computerized memory; and
(E) has submitted the blood glucose logs from the monitoring device to the endocrinologist or treating physician at the time of the annual medical examination. (Burns Ind. Code Ann. § 8-2.1-24-18(g))

iii. Indiana drivers are required to reduce speed and to take into consideration bad weather conditions. An Indiana semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Indiana driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Indiana License:
i. Indiana semi truck driver must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Indiana (49 CFR § 383.23(a)(2))
iii. The driver has successfully completed a Indiana road test (49 CFR § 383.23(a))

e. Indiana Certifications:
i. Has any and all certifications required by Indiana employer / Indiana motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate a Indiana semi truck / Indiana motor carrier  (49 CFR § 391.15)

f. Indiana Intrastate Regulations:
i. Except as provided in section 18 [IC 8-2.1-24-18] of this chapter, this chapter does not apply to the following:

(1) Motor vehicles used exclusively for carrying United States
mail.
(2) Motor vehicles while being used or operated under the control, direction, and supervision of:
(A) the United States government, the state, or a political
subdivision; or
(B) the board of trustees of a state institution.
(3) Motor vehicles while transporting supplies, livestock feed ingredients, fertilizer, or fertilizing materials that are in transit to or from farms.
(4) Motor vehicles:
(A) controlled and operated by a farmer when used in the
transportation of the farmer's agricultural commodities and products of those commodities or in the transportation of supplies to the farm;
(B) controlled and operated by a nonprofit agricultural cooperative association (or by a federation of agricultural cooperative associations if the federation does not possess greater powers or purposes than the cooperative associations);
(C) used in carrying property consisting of livestock or agricultural commodities (not including manufactured products) if the motor vehicles are not used in carrying:
(i) other property;
(ii) agricultural commodities; or
(iii) passengers;
for compensation; or
(D) used in carrying livestock feed or feed ingredients, if those products are transported to a site of agricultural productions or to a business enterprise engaged in the sale of agricultural goods to a person engaged in agricultural production.
This chapter shall not be construed to apply to motor vehicles owned, leased, controlled, or operated by a nonprofit cooperative association, either incorporated or unincorporated, that was in existence on July 6, 1961.
(5) Motor vehicles, commonly known as armored cars, used exclusively to transport, under written bilateral contract, coin, currency, bullion, securities, precious metals, jewelry, precious stones, money, legal tender, stocks and bonds, negotiable and nonnegotiable instruments and securities, postage and revenue stamps, and other valuable documents and rare objects. (Burns Ind. Code Ann. § 8-2.1-24-3)

ii. A motor carrier may not operate a motor vehicle in the transportation of property, upon a public highway in intrastate commerce until the motor carrier has:

(1) Submitted forms approved by the department to be a properly certified motor carrier; and

(2) Been issued an acknowledgment by the department.

An acknowledgment issued under subdivision (2) remains in effect until December 31 of the year in which the acknowledgment is issued. (Burns Ind. Code Ann. § 8-2.1-24-15)

iii. The provisions of 49 CFR 395 that regulate the hours of service of drivers, including requirements for the maintenance of logs, do not apply to a driver of a truck that is registered by the bureau of motor vehicles and used as a farm truck under IC 9-18, or a vehicle operated in intrastate construction or construction related service, or the restoration of public utility services interrupted by an emergency. Except as provided in subsection (i), intrastate motor carriers not operating under authority issued by the United States Department of Transportation shall comply with the requirements of 49 CFR 390.21(b)(3) by registering with the department of state revenue as an intrastate motor carrier and displaying the certification number issued by the department of state revenue preceded by the letters "IN". (Burns Ind. Code Ann. § 8-2.1-24-18(a))

iv. Notwithstanding subsection (b), nonspecification bulk and nonbulk packaging, including cargo tank motor vehicles, may be used only if all the following conditions exist:
(1) The maximum capacity of the vehicle is less than three thousand five hundred (3,500) gallons.
(2) The shipment of goods is limited to intrastate commerce.
(3) The vehicle is used only for the purpose of transporting fuel oil, kerosene, diesel fuel, gasoline, gasohol, or any combination of these substances. (Burns Ind. Code Ann. § 8-2.1-24-18(c))

v. Notwithstanding subsection (a) or (b), the following provisions of 49 CFR do not apply to private carriers of property operated only in intrastate commerce or any carriers of property operated only in intrastate commerce while employed in construction or construction related service:
(2) Subpart 396.9 as it applies to inspection of vehicles carrying or loaded with a perishable product. However, this exemption does not prohibit a law enforcement officer from stopping these vehicles for an obvious violation that poses an imminent threat of an accident or incident. The exemption is not intended to include refrigerated vehicles loaded with perishables when the refrigeration unit is working.
(3) Subpart 396.11 as it applies to driver vehicle inspection reports.
(4) Subpart 396.13 as it applies to driver inspection. (Burns Ind. Code Ann. § 8-2.1-24-18(g))

vi. For purposes of 49 CFR 395.1(l), "planting and harvesting season" refers to the period between January 1 and December 31 of each year. The intrastate commerce exception set forth in 49 CFR 395.1(l), as it applies to the transportation of agricultural commodities and farm supplies, is restricted to single vehicles and cargo tank motor vehicles with a capacity of not more than five thousand four hundred (5,400) gallons. (Burns Ind. Code Ann. § 8-2.1-24-18(h))

vii. The requirements of 49 CFR 390.21 do not apply to an intrastate carrier or a guest operator not engaged in interstate commerce and operating a motor vehicle as a farm vehicle in connection with agricultural pursuits usual and normal to the user's farming operation or for personal purposes unless the vehicle is operated either part time or incidentally in the conduct of a commercial enterprise. (Burns Ind. Code Ann. § 8-2.1-24-18(i))

g. Indiana Driver Responsibility:
a. Hours of Service

i. (a) No motor carrier shall permit or require any driver used by it to
 drive a property-carrying commercial motor vehicle, nor shall any
 such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or (2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property- carrying driver complies with the provisions of Sec. 395.1(o). (b) No motor carrier shall permit or require a driver of a property- carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of
motor carriers using the driver's services, for any period after—(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or (2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week. (c)(1)Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or (2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

 ii. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

b. Truck Driver Logs
i. A Indiana tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Indiana employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations. (49 CFR § 395.8)

ii. Driver Logs: §395.8 involve a Indiana driver making a record of his duty status. A Indiana driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iii. Because of technology, the Indiana driver log is often kept by an on-board recording device. The log indicates when the Indiana driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Indiana motor carrier is responsible if the tractor trailer driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether a Indiana driver keeps two sets of logs or books, so that he or she could driver longer than they are allowed to drive by Indiana law.

iv. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

v. A Indiana motor carrier (that would be the trucking company) is responsible and required to fashion or schedule their Indiana truck driver’s runs and routes in a way that would allow Indiana drivers to complete them without violating any speed limits or Hours-of-Service violations.

vi. Indiana tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

c. Alcohol and Controlled Substances
i.  Alcohol and drivers of Arizona tractor trailers (semi trucks): No
 trucker shall report for duty or remain on duty requiring the
 performance of safety-sensitive functions while having an alcohol
 concentration of 0.04 or greater. No employer having actual
knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions. This, of course, includes driving, but also when Arizona drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. No driver shall use alcohol while performing safety-sensitive
functions. No employer having actual knowledge that a driver is using alcohol while performing safety-sensitive functions shall permit the driver to perform or continue to perform safety-sensitive functions. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires
the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

b) Truck Equipment & Repair
i. A driver of a Indiana tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

ii. Title 49, Part 393 includes brakes to the tractor, brakes to the
trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE
FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities were a result from a collision involving a large truck.

2. It is important for regulations to be followed so that
violations do not result in an Arizona semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iii. The Indiana driver is responsible to make sure even their
emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

iv. An Indiana driver must make sure that emergency
 equipment is in place and ready to be used at any time. (49 CFR §
393.95)

b) Disqualifications of Driver:

i) Indiana motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. 49 CFR § 391.15)
ii) Some disqualifying offenses of Indiana semi truck drivers include (but are not limited to):
(1) Driving with a revoked or suspended license
(2) Driving while under the influence of alcohol or drugs
(3) Leaving an accident scene that involves a commercial motor vehicle (semi truck)
(4) Committing a felony with the use of a commercial motor vehicle (semi truck)
(5) Speeding, or Reckless Driving
(6) Improper and/or erratic traffic lane changes
(7) Following another vehicle too closely when driving the semi truck
(8) Railroad crossing violations when driving the semi truck

3. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Indiana semi truck drivers:
i. No additional routes have been federally designated; under State law STAA-dimensioned commercial vehicles may legally operate on all highways which, prior to June 1, 1991, were designated as Federal-aid primary highways.

4. FALLEN CARGO:  Many Indiana semi truck accidents occur because cargo has fall from the Indiana truck’s trailer and injured another Indiana motorist. Often when Indiana semi truck accidents occur because of fallen cargo it is a result of the Indiana driver not securing the cargo properly. There are certain rules that Indiana semi truck drivers must follow when securing cargo.

5. LAW: Indiana adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Indiana.

6. INDIANA IS AN AT-FAULT STATE.

a. Indiana is a at-fault state: This means that the law of negligence governs Indiana motor vehicle accidents. The person who is found to be “at fault” for the Indiana semi truck accident can be held accountable for your injuries and damages in your Indiana semi truck crash.
b. Indiana Uninsured Motorist Coverage: If you are involved in an Indiana motorcycle accident with an at-fault driver who has no insurance, or inadequate insurance, to cover your claims, uninsured motorist coverage may protect you in this situation.
i. Underinsured Motorist: If you are involved in an Indiana motorcycle accident with an underinsured motorist who is at-fault for the Indiana motorcycle accident, UIM coverage may protect you if the underinsured at-fault driver does not have adequate insurance to cover your claims.
ii. Uninsured Motorist: If you are involved in an Indiana motorcycle accident with an uninsured motorist who is at-fault for the Indiana motorcycle accident, UIM coverage may protect you if the uninsured at-fault driver does not have any insurance to cover your claims. c. Statute of Limitations:
