The following law may apply to a Maryland tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Maryland. They include rules drivers, their employers, and owners of trucks must follow.

The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi trucks) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

MARYLAND TRUCKING LAW

Maryland tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of the highlights are listed below.

2. MARYLAND SEMI TRUCK DRIVER QUALIFICATIONS:

Both Federal and Maryland state safety regulations require that Maryland drivers of semi trucks (tractor trailers) meet certain qualifications. Each Maryland driver employed by a motor carrier (the trucking company) is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years. Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of A Maryland tractor trailer (semi truck) driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of a Maryland driver is at least 18 years old. (COMAR 11.21.01.06)

b. Language:
i. English: Maryland semi truck drivers must be able to speak, understand, and converse in the English language.
ii. Maryland tractor trailer (semi truck) drivers must understand traffic signs.
iii. Maryland semi truck drivers must be able to make records and reports in English. (49 CFR 391.11(b)(2))

c. Operation of Maryland Motor Carrier (Employer):
i. Experience or training qualifies Maryland tractor trailer (semi truck) drivers to safely operate A Maryland semi truck (tractor trailer) or Maryland commercial vehicle. (49 CFR § 391.13)
ii. Maryland semi truck drivers must have the physical capability to operate motor carrier. (49 CFR § 391.41)
1. An intrastate driver who does not operate a bus or who does not transport hazardous materials of a type and quantity requiring placarding under federal hazardous materials regulations, or who does not operate a vehicle designed to transport 16 or more passengers, including the driver, and who does not meet the physical qualifications of 49 CFR § 391.41(b), may drive in intrastate commerce if issued a waiver for intrastate operation by the Administrator. The waiver is valid for up to 2 years from the date of issue. (COMAR 11.21.01.06)
iii. Maryland tractor trailer (semi truck) drivers are required to reduce speed and to take into consideration bad weather conditions. A Maryland semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Maryland driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Maryland License:
i. Maryland semi truck drivers must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Maryland (49 CFR § 383.23(a)(2))
iii. The semi truck driver has successfully completed Maryland road test (49 CFR § 383.23(a))

e. Maryland Certifications:
i. Has any and all certifications required by Maryland employer / Maryland motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate a Maryland semi truck / Maryland motor carrier  (49 CFR § 391.15)

f. Maryland Driver Responsibility:
a. Hours of Service
i. No motor carrier shall permit or require any driver used by it to drive a property-carrying commercial motor vehicle, nor shall any such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or
(2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property-carrying driver complies with the provisions of Sec. 395.1(o).
(b) No motor carrier shall permit or require a driver of a property-carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after--
(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
(c)(1) Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or
(2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

ii. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

b. Truck Driver Logs
i. A Maryland tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Maryland employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations.  (49 CFR § 395.8)

ii. Driver Logs: 49 CFR § 395.8 involve A Maryland tractor trailer (semi truck) driver making a record of his duty status. A Maryland driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iii. Because of technology, the Maryland semi truck driver log is often kept by an on-board recording device. The log indicates when the Maryland driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Maryland motor carrier is responsible if the tractor trailer (semi truck) driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether a Maryland driver keeps two sets of logs or books, so that he or she could drive longer than they are allowed to drive by Maryland law.

iv. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

v. A Maryland motor carrier (the trucking company) is responsible and required to fashion or schedule their Maryland truck driver’s runs and routes in a way that would allow Maryland drivers to complete them without violating any speed limits or Hours-of-Service violations. 

vi. Maryland tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

c. Alcohol and Controlled Substances
i. Alcohol and drivers of Maryland tractor trailers (semi trucks): A trucker cannot have any alcohol in his or her system at all while driving a tractor trailer (semi truck). This, of course, includes driving, but also when Maryland drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. Alcohol is not tolerated whatsoever, which is different from drivers of cars, certain vans, and motorcycles that have alcohol in their system up to certain limits, and still may be able to legally drive. The rules involving Maryland truck drivers are extremely strict. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

d. Truck Equipment & Repair
i. A driver of A Maryland tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

ii. This section of the Federal Motor Carrier Safety Regulations includes brakes to the tractor, brakes to the trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities in were a result from a collision involving a large truck.
2. It is important for regulations to be followed so that violations do not result in a Maryland semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iii. The Maryland tractor trailer (semi truck) driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

iv. A Maryland semi truck driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)

v. A person may not cause, allow, or permit the operation of a diesel vehicle on any highway in Maryland, if the vehicle:

(1) Discharges exhaust emissions, the opacity of which exceeds the applicable emissions opacity standards under Regulation .06 of this chapter; or

(2) Has emission control, exhaust equipment, or a governor installed either on the vehicle or diesel engine which has been disconnected, detached, or deactivated, or in any other way has been rendered inoperable or less effective than designed by the original equipment or vehicle or engine manufacturer. (COMAR 11.21.02.04)

e. Intrastate Regulations:

i. (1) Except as provided for in paragraph (2) of this subsection, regulations adopted under this section for intrastate motor carrier transportation may not:

      (i) Apply the provisions of § 391.21, § 391.23, §
391.31, or § 391.35 of the Federal Motor Carrier Safety Regulations to:

         1. A driver who is a regularly employed driver of
a motor carrier for a continuous period that began before July 1, 1986, if the driver continues to be a regularly employed driver of the motor carrier; or

2. The motor carrier, with regard to a driver described under item 1 of this subparagraph, if the motor carrier continues to employ the driver;

(ii) Limit a driver's time or hours on duty if:

       1. The driver operates only within a 150 air mile    
           radius of the driver's normal work reporting        
           location;

       2. The driver returns to the driver's normal work 
           reporting location;

       3. The driver is released from work within a 
           period of 16 consecutive hours, not more than
          12 of which are dedicated to driving, and is
           given at least 8 consecutive hours off duty; and

       4. Regardless of the number of motor carriers
           using the driver's services, the driver:

            A. If the employing motor carrier does not
                 operate motor vehicles every day of the 
                 week, has been on duty no more than 70 
                 hours in a period of 7 consecutive days; or

            B. If the employing motor carrier operates
                motor vehicles every day of the week, has   
                been on duty no more than 80 hours in a 
                period of 8 consecutive days;

(iii) Require a driver to maintain a record of duty status if the driver is not subject to item (ii) of this paragraph, except that, if a driver is on duty for a period of more than 12 hours, the driver shall maintain a record of the driver's duty status that:

         1. For the first 12 hours of time on duty,
             accounts for all time dedicated to driving; and

         2. For all time on duty in excess of 12 hours,
             conforms to federal regulations;

(iv) Apply the provisions of this paragraph or Parts 391 and 395 of the Federal Motor Carrier Safety Regulations to a farmer, or an agent or employee of a farmer, who operates farm equipment or a motor vehicle owned or operated by the farmer in the transportation of supplies to a farm or the transportation of farm products as defined in § 10-601 of the Agriculture Article within 150 air miles of the farmer's farm; or

(v) Except in the case of bus drivers, apply the provisions of § 391.41 (b) (1) through (11) of the Federal Motor Carrier Safety Regulations before October 1, 2023 to any person who:

         1. On October 1, 2003, was otherwise qualified
to operate and operated a vehicle or vehicle combination used in intrastate commerce with a gross vehicle weight rating or gross combination weight rating of 10,001 pounds or more and, after October 1, 2003, remained qualified to operate and continued to operate such a vehicle;

2. Operates only in intrastate commerce; and

3. Has a mental or physical condition which would disqualify the person under the Federal Motor Carrier Safety Regulations and:

            A. The condition existed on October 1,  
  2003 or at the time of the first
physical examination after that date
to which the person submitted as
required by regulations adopted by
the Administration under subsection
(k) of this section; and

B. A physician who has examined the
person has determined that the
condition has not substantially
worsened and that no other
disqualifying medical or physical
condition has developed since
October 1, 2003 or the time of the
first required physical examination
after that date.
(2) Nothing contained in this subsection limits regulation of the qualifications or hours of service of a driver of a vehicle:

      (i) In interstate commerce;

      (ii) Transporting hazardous materials of a type and
quantity requiring placarding under Federal Hazardous Materials Regulations; or
(iii) Designed to transport 16 or more passengers,
including the driver. (Md. TRANSPORTATION
Code Ann. § 25-111)

ii. 49 CFR § 390.23(a). For a utility or transportation emergency declared under Transportation Article, § 25-111(j), Annotated Code of Maryland, a motor carrier or driver operating a motor vehicle to provide emergency relief during an emergency is exempt from 49 CFR 395 only. Other exemptions in 49 CFR § 390.23(a) do not apply during an emergency declared pursuant to Transportation Article, § 25-111(j), Annotated Code of Maryland. (COMAR 11.21.01.05)

iii. In general. -- Every truck, truck tractor, and bus operated on highways in this State, except as provided in subsection (b) of this section, shall be identified with the name or trade name of its owner, operator, or lessee and shall display:

(1) A United States Department of Transportation number; or

(2) The number issued by a State agency.

(b) Exceptions. -- This section does not apply to the following if operated intrastate only:

(1) Vehicles registered as:

(i) Farm trucks under § 13-921 of this article;

(ii) Farm truck tractors under § 13-924 of this article; or

(iii) Farm area motor vehicles under § 13-935 of this article;

(2) Trucks registered at 10,000 pounds capacity or less;

(3) Emergency vehicles;

(4) Vehicles used primarily to transport money or commercial paper;

(5) Vehicles owned or operated by the State or any political subdivision of the State; or

(6) Vehicles operating within 15 days from the date of purchase. (Md. TRANSPORTATION Code Ann. § 22-404.3)

f. Disqualifications of Driver:

i. Maryland motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. (49 CFR § 391.15)
ii. Some disqualifying offenses of Maryland semi truck drivers include (but are not limited to):
1. Driving with a revoked or suspended license
2. Driving while under the influence of alcohol or drugs
3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)
4. Committing a felony with the use of a commercial motor vehicle (semi truck)
5. Speeding, or Reckless Driving
6. Improper and/or erratic traffic lane changes
7. Following another vehicle too closely when driving the semi truck
8. Railroad crossing violations when driving the semi truck

3. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Maryland semi truck drivers:

US 13 VA State Line DE State Line. US 15 US 40/340 Frederick MD 26 Frederick. US 40 US 15/340 Frederick I-70/270 Frederick. US 48 WV State Line I-70 Hancock. US 50 MD 201/Kenilworth Ave. Cheverly US 13 Salisbury. US 301 VA State Line DE State Line. US 340 MD 67 Weverton US 15/40 Frederick. MD 3 US 50/301 Bowie I-695/MD 695 Glen Burnie. MD 4 I-95 Forestville US 301 Upper Marlboro. MD 10 MD 648 Glen Burnie MD 695 Glen Burnie. MD 100 MD 3 MD 607 Jacobsville. MD 201 (Kenilw. Ave.) D.C. Line US 50 Cheverly. MD 295 I-695 Linthicum I-95 Baltimore. MD 695 I-695/MD 3 Glen Burnie I-95/695 Kenwood. MD 702 Old Eastern Avenue MD 695 Essex. 4. FALLEN CARGO:  Many Maryland semi truck accidents occur because cargo has fallen from the Maryland truck’s trailer and injured another Maryland motorist. Often when Maryland semi truck accidents occur because of fallen cargo it is a result of the Maryland driver not securing the cargo properly. There are certain rules that Maryland semi truck drivers must follow when securing cargo.

5. LAW: Maryland adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Maryland.

6. MARYLAND IS AN AT-FAULT STATE.

i. Maryland is an at-fault state: This means that when you are injured in a Maryland semi truck accident, the law of negligence will govern your claim. The at-fault driver is responsible for your injuries. The law of contributory negligence may hold you accountable for a portion of your own injuries and damages arising out of your Maryland semi truck crash if you were partially at-fault as well.
