NATIONAL TRUCKING LAW

 

The following law may apply to a Minnesota tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Minnesota. They include rules drivers, their employers, and owners of trucks must follow. The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi truck) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov. The federal law in its entirety can be found in Title 49 of the Federal Code.

 

MINNESOTA TRUCKING LAW

 

Minnesota tractor trailer, or semi truck accident law may be a little different than the federal law. Some of the highlights are listed below.

  1. MINNESOTA SEMI TRUCK DRIVER QUALIFICATIONS:

 

Both federal and Minnesota state safety regulations require that Minnesota drivers of semi trucks (tractor trailers) meet certain qualifications. Each Minnesota driver employed by a motor carrier is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years (49 CFR 391.51). Other requirements that must be met include:

 

  1. Age:

      1. Interstate Travel: (traveling within 2 or more states). The required age of a Minnesota semi truck driver is at least 21 years old. (49 CFR § 391.11(b)(1))

      2. Intrastate Travel: (within a single state). The required age of a Minnesota tractor trailer (semi truck) driver is at least 18 years old. (Minn. Stat. § 221.0314)

 

  1. Language:

      1. English: Minnesota semi truck driver must be able to speak, understand, and converse in the English language.

      2. Minnesota driver must understand traffic signs.

      3. Minnesota driver must be able to make records and reports in English.

 

  1. Operation of Minnesota Motor Carrier (Employer):

      1. Experience or training qualifies Minnesota driver to safely operate a Minnesota semi truck or Minnesota commercial vehicle. (49 CFR § 391.13)

 

    1. Has physical capability to operate motor carrier (49 CFR § 391.41)

 

  1. A person who is not physically qualified to drive under subdivision 2, but who meets the other qualifications under subdivision 2, may drive a motor vehicle if the commissioner grants a waiver to that person. The commissioner may grant a waiver to a person who is not physically qualified to drive under Code of Federal Regulations, title 49, section 391.41, paragraph (b)(1) or (b)(2), according to rules adopted under section 221.031. (Minn. Stat. § 221.0314)

  2. The commissioner may grant a waiver to a person who is not physically qualified to drive under Code of Federal Regulations, title 49, section 391.41, paragraph (b)(3) to (b)(13). A waiver granted under this subdivision applies to intrastate transportation only. (Minn. Stat. § 221.0314)

  3. Notwithstanding subdivisions 3 and 3a, a Minnesota intrastate waiver is not required in Minnesota intrastate commerce if that person holds a valid interstate waiver or comparable document for physical qualifications described in Code of Federal Regulations, title 49, section 391.41. (Minn. Stat. § 221.0314)

 

    1. Minnesota semi truck drivers are required to reduce speed and to take into consideration bad weather conditions. A Minnesota semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Minnesota driver to stop their vehicle all together. (49 CFR § 392.14)

 

  1. Valid Minnesota License:

      1. Minnesota semi truck driver must possess a currently valid C.D.L. (Commercial Driver’s License)

      2. The valid C.D.L. is issued by Minnesota (49 CFR § 383.23(a)(2))

      3. The driver has successfully completed a Minnesota road test (49 CFR § 383.23(a))

 

  1. Minnesota Certifications:

      1. Has any and all certifications required by Minnesota employer / Minnesota motor carrier (49 CFR § 391.27(c))

      2. Is not disqualified to operate a Minnesota semi truck / Minnesota motor carrier (49 CFR § 391.15)

 

  1. Minnesota Intrastate Regulations:

  1. The rules for hours of service of drivers do not apply to private carriers who are (1) public utilities as defined in section 216B.02, subdivision 4; (2) cooperative electric associations organized under chapter 308A; (3) telephone companies as defined in section 237.01, subdivision 7; or (4) engaged in the transportation of construction materials, tools and equipment from shop to job site or job site to job site, for use by the private carrier in the new construction, remodeling, or repair of buildings, structures or their appurtenances.

    The rules for driver qualifications and hours of service of drivers do not apply to vehicles controlled by a farmer and operated by a farmer or farm employee to transport agricultural products, farm machinery, or supplies to or from a farm if the vehicle is not used in the operations of a motor carrier and not carrying hazardous materials of a type or quantity that requires the vehicle to be marked or placarded in accordance with section 221.033.

    The rules for driver qualifications do not apply to a driver employed by a private carrier while operating a lightweight vehicle. (Minn. Stat. § 221.031)

 

  1. Notwithstanding the provisions of subdivision 2, private carriers engaged in intrastate commerce and operating vehicles transporting agricultural and other farm products within an area having a 50-mile radius from the business location of the private carrier must comply only with the rules for driver qualifications; driving of motor vehicles; and parts and accessories necessary for safe operation, except as provided in paragraphs (b) and (c).

    A rear-end dump truck or other rear-unloading truck while being used for hauling agricultural and other farm products from a place of production or on-farm storage site to a place of processing or storage, is not subject to any rule of the commissioner requiring rear-end protection, including a federal regulation adopted by reference.

    A private carrier operating a commercial motor vehicle as defined in section 169.781, subdivision 1, must comply with sections 169.781 to 169.783. (Minn. Stat. § 221.031)

 

  1. This subdivision applies to persons engaged in intrastate commerce who operate vehicles providing transportation described in section 221.025 with a gross vehicle weight in excess of 10,000 pounds, except school buses, commuter vans, and authorized emergency vehicles.

    Persons providing transportation described in section 221.025, clause (6), (10), (12), or (13), must comply with the rules for driving of motor vehicles and for parts and accessories necessary for safe operation.

    Persons providing transportation described in section 221.025, except for persons providing transportation described in clause (6), (10), (12), or (13), must comply with the rules for driving of motor vehicles; parts and accessories necessary for safe operation; and, after August 1, 1994, the rules for driver qualifications. (Minn. Stat. § 221.031)

 

  1. Trucks equipped with auxiliary power units (APUs) have had their gross vehicle weight increased to 80,400 pounds on Minnesota state roads. This provision clarifies that anyone driving through Minnesota can run at 80,400 pounds legally. ***Found at the Minnesota Trucking Association Value Statement website.

 

  1. Spotter trucks with a MCO stating “Not for On Road Use” will have a five year window (2013) to operate on public roads without a license plate. After five years, spotter trucks used on roads or in uncontrolled parking lots must be designated as for on road use and be licensed according to DVS regulations. ***Found at the Minnesota Trucking Association Value Statement website.

 

 

  1. Minnesota Driver Responsibility:

    1. Hours of Service

 

            1. (a) No motor carrier shall permit or require any driver used by it to

drive a property-carrying commercial motor vehicle, nor shall any

such driver drive a property-carrying commercial motor vehicle:

(1) More than 11 cumulative hours following 10 consecutive hours off duty; or (2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property- carrying driver complies with the provisions of Sec. 395.1(o). (b) No motor carrier shall permit or require a driver of a property- carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of

motor carriers using the driver's services, for any period after—(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or (2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week. (c)(1)Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or (2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

  1. Code of Federal Regulations, title 49, part 395, is incorporated by reference, except that paragraphs (a), (c), (d), (f), (h), (i), (k), (m), and (n) of section 395.1 and section 395.13 of that part are not incorporated. In addition, cross-references to sections or paragraphs not incorporated in this subdivision are not incorporated by reference. The requirements of Code of Federal Regulations, title 49, part 395, do not apply to drivers of lightweight vehicles. (Minn. Stat. § 221.0314)

  2. The federal regulations incorporated in subdivision 9 for maximum driving and on-duty time do not apply to drivers engaged in the interstate or intrastate transportation of:
    (1) agricultural commodities or farm supplies for agricultural purposes in Minnesota during the planting and harvesting seasons from March 15 to December 15 of each year; or
    (2) sugar beets during the harvesting season for sugar beets from September 1 to May 15 of each year;
    if the transportation is limited to an area within a 100-air-mile radius from the source of the commodities or the distribution point for the farm supplies. (Minn. Stat. § 221.0314)

 

            1. From August 1, 1992, to August 1, 1994, the rules for hours of service of drivers do not apply to a person exclusively engaged in the transportation of asphalt cement, cementitious material, fly ash, or sod, construction debris, and solid waste when transported by a transfer driver, when the transportation is provided within a radius of 100 miles from (1) the person's home post office, or (2) a highway construction or maintenance site where the asphalt cement, cementitious material, fly ash, or sod is being used. (Minn. Stat. § 221.031)

 

iii. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

 

    1. Truck Driver Logs

      1. A Minnesota tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Minnesota employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations. (49 CFR § 395.8)

 

    1. Driver Logs: §395.8 involve a Minnesota semi truck driver making a record of his duty status. A Minnesota driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

 

    1. Because of technology, the Minnesota driver log is often kept by an on-board recording device. The log indicates when the Minnesota driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Minnesota motor carrier is responsible if the tractor trailer driver submits a false log. (49 CFR § 395.15)

 

      1. There are sometimes investigations regarding whether a Minnesota tractor trailer (semi truck) driver keeps two sets of logs or books, so that he or she could driver longer than they are allowed to drive by Minnesota law.

 

    1. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

 

 

 

    1. A Minnesota motor carrier (that would be the trucking company) is responsible and required to fashion or schedule their Minnesota truck driver’s runs and routes in a way that would allow Minnesota drivers to complete them without violating any speed limits or Hours-of-Service violations.

 

    1. Minnesota tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

 

    1. Alcohol and Controlled Substances

i. Alcohol and drivers of Minnesota tractor trailers (semi trucks): No

trucker shall report for duty or remain on duty requiring the

performance of safety-sensitive functions while having an alcohol

concentration of 0.04 or greater. No employer having actual

knowledge that a driver has an alcohol concentration of 0.04 or greater shall permit the driver to perform or continue to perform safety-sensitive functions. This, of course, includes driving, but also when Arizona drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

 

            1. No tractor trailer (semi truck) driver shall use alcohol while performing safety-sensitive functions. No employer having actual knowledge that a driver is using alcohol while performing safety-sensitive functions shall permit the driver to perform or continue to perform safety-sensitive functions. (49 CFR § 382.205)

 

            1. No semi truck driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

 

    1. Truck Equipment & Repair

            1. A driver of a Minnesota tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

            2. Code of Federal Regulations, title 49, part 396, is incorporated by reference, except that sections 396.9; 396.11, paragraph (d); 396.17; 396.19; 396.21; and 396.23 of that part are not incorporated. Minn. Stat. § 221.0314)

 

            1. Title 49, Part 393 includes brakes to the tractor, brakes to the

trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

 

      1. STUDIES SHOW THAT BRAKE

FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities were a result from a collision involving a large truck.

 

      1. It is important for regulations to be followed so that

violations do not result in an Arizona semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

 

            1. The Minnesota semi truck driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

 

            1. An Minnesota tractor trailer (semi truck) driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)

 

v. Vehicle identification rule:
(a) The following carriers shall display the carrier's name on the power unit of each vehicle:
(1) motor carriers, regardless of the weight of the vehicle, except that this requirement does not apply to a limousine as defined in section 168.002, subdivision 15, that is equipped with "LM" license plates;
(2) interstate and intrastate private carriers operating vehicles with a gross vehicle weight of more than 10,000 pounds; and
(3) vehicles providing transportation described in section 221.025 with a gross vehicle weight of more than 10,000 pounds except those providing transportation described in section 221.025, clauses (1), (3), and (4).
Vehicles described in clauses (2) and (3) that are operated by farmers or farm employees and have four or fewer axles are not required to comply with the vehicle identification rule of the commissioner.
(b) Vehicles subject to this subdivision must show the name or "doing business as" name of the carrier operating the vehicle. If the carrier operates a leased vehicle, it may show its name and the name of the lessor on the vehicle, if the lease relationship is clearly shown. If the name of a person other than the operating carrier appears on the vehicle, the words "operated by" must immediately precede the name of the carrier.
(c) The name must be in letters that contrast sharply in color with the background, be readily legible during daylight hours from a distance of 50 feet while the vehicle is stationary, and be maintained in a manner that retains the legibility of the markings. The name may be shown by use of a removable device if that device meets the identification and legibility requirements of this subdivision. (Minn. Stat. § 221.031)

 

vi. The provisions of this chapter requiring a certificate or permit to operate as a motor carrier do not apply to the intrastate transportation described below:
(1) the transportation of students to or from school or school activities in a school bus inspected and certified under section 169.451 and the transportation of children or parents to or from a Head Start facility or Head Start activity in a Head Start bus inspected and certified under section 169.451;
(2) the transportation of solid waste, as defined in section 116.06, subdivision 22, including recyclable materials and waste tires, except that the term "hazardous waste" has the meaning given it in section 221.012, subdivision 18;
(3) a commuter van as defined in section 221.012, subdivision 9;
(4) authorized emergency vehicles as defined in section 169.011, subdivision 3, including ambulances; and tow trucks equipped with proper and legal warning devices when picking up and transporting (i) disabled or wrecked motor vehicles or (ii) vehicles towed or transported under a towing order issued by a public employee authorized to issue a towing order;
(5) the transportation of grain samples under conditions prescribed by the commissioner;
(6) the delivery of agricultural lime;
(7) the transportation of dirt and sod within an area having a 50-mile radius from the home post office of the person performing the transportation;
(8) the transportation of sand, gravel, bituminous asphalt mix, concrete ready mix, concrete blocks or tile and the mortar mix to be used with the concrete blocks or tile, or crushed rock to or from the point of loading or a place of gathering within an area having a 50-mile radius from that person's home post office or a 50-mile radius from the site of construction or maintenance of public roads and streets;
(9) the transportation of pulpwood, cordwood, mining timber, poles, posts, decorator evergreens, wood chips, sawdust, shavings, and bark from the place where the products are produced to the point where they are to be used or shipped;
(10) the transportation of fresh vegetables from farms to canneries or viner stations, from viner stations to canneries, or from canneries to canneries during the harvesting, canning, or packing season, or transporting sugar beets, wild rice, or rutabagas from the field of production to the first place of delivery or unloading, including a processing plant, warehouse, or railroad siding;
(11) the transportation of property or freight, other than household goods and petroleum products in bulk, entirely within the corporate limits of a city or between contiguous cities except as provided in section 221.296;
(12) the transportation of unprocessed dairy products in bulk within an area having a 100-mile radius from the home post office of the person providing the transportation;
(13) the transportation of agricultural, horticultural, dairy, livestock, or other farm products within an area having a 100-mile radius from the person's home post office and the carrier may transport other commodities within the 100-mile radius if the destination of each haul is a farm;
(14) the transportation of newspapers, as defined in section 331A.01, subdivision 5, telephone books, handbills, circulars, or pamphlets in a vehicle with a gross vehicle weight of 10,000 pounds or less; and
(15) transportation of potatoes from the field of production, or a storage site owned or otherwise controlled by the producer, to the first place of processing.
The exemptions provided in this section apply to a person only while the person is exclusively engaged in exempt transportation. (Minn. Stat. § 221.025)

 

    1. Disqualifications of Driver:

 

    1. Minnesota motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. 49 CFR § 391.15)

    2. Some disqualifying offenses of Minnesota semi truck drivers include (but are not limited to):

      1. Driving with a revoked or suspended license

      2. Driving while under the influence of alcohol or drugs

      3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)

      4. Committing a felony with the use of a commercial motor vehicle (semi truck)

      5. Speeding, or Reckless Driving

      6. Improper and/or erratic traffic lane changes

      7. Following another vehicle too closely when driving the semi truck

      8. Railroad crossing violations when driving the semi truck

  1. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Minnesota semi truck drivers:

  1. FALLEN CARGO: Many Minnesota semi truck accidents occur because cargo has fall from the Minnesota truck’s trailer and injured another Minnesota motorist. Often when Minnesota semi truck accidents occur because of fallen cargo it is a result of the Minnesota driver not securing the cargo properly. There are certain rules that Minnesota semi truck drivers must follow when securing cargo.

 

  1. LAW: Minnesota adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Minnesota.

 

  1. MINNESOTA IS A NO-FAULT STATE.

 

  1. Minnesota is a no-fault state: Subdivision 1. If the accident causing injury occurs in this state, every person suffering loss from injury arising out of maintenance or use of a motor vehicle or as a result of being struck as a pedestrian by a motorcycle has a right to basic economic loss benefits. Minn. Stat. § 65B.46 (2008)

  2. Economic Losses include, but may not be limited to:

        1. Medical Expenses

        2. Income Loss

        3. Replacement Services Loss

        4. Funeral Expense Loss

        5. Survivor’s Economic Loss

        6. Survivor’s Replacement Services Loss

 

    1. Non-Economic Damages that may be recoverable include:

          1. Permanent Serious Disfigurement

          2. Permanent Injury

          3. Death

          4. Disability for 60 or more days


 

    1. Non-Economic Damages can be recovered in a tort suit, pursuant to Minnesota Statute 65B.51:

Subd. 3. Limitation of damages for noneconomic detriment. In an action described in subdivision 1, no person shall recover damages for noneconomic detriment unless:

(a) The sum of the following exceeds $4,000:

(1) reasonable medical expense benefits paid, payable or payable but for any applicable deductible, plus

(2) the value of free medical or surgical care or ordinary and necessary nursing services performed by a relative of the injured person or a member of the injured person's household, plus

(3) the amount by which the value of reimbursable medical services or products exceeds the amount of benefit paid, payable, or payable but for an applicable deductible for those services or products if the injured person was charged less than the average reasonable amount charged in this state for similar services or products, minus

(4) the amount of medical expense benefits paid, payable, or payable but for an applicable deductible for diagnostic X-rays and for a procedure or treatment for rehabilitation and not for remedial purposes or a course of rehabilitative occupational training; or

(b) the injury results in:


(1) permanent disfigurement;
(2) permanent injury;
(3) death; or
(4) disability for 60 days or more.

(c) For the purposes of clause (a) evidence of the reasonable value of medical services and products shall be admissible in any action brought in this state.

For the purposes of this subdivision disability means the inability to engage in substantially all of the injured person's usual and customary daily activities.

 

    1. Statute of Limitations:

If you are injured in a Minnesota semi truck accident, you have two (2) years from the date of the accident to commence suit, if you wish to do so.
