The following law may apply to an Oklahoma tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Oklahoma. They include rules drivers, their employers, and owners of trucks must follow.

The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi trucks) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

OKLAHOMA TRUCKING LAW

Oklahoma tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of the highlights are listed below.

2. OKLAHOMA SEMI TRUCK DRIVER QUALIFICATIONS:

Both Federal and Oklahoma state safety regulations require that Oklahoma drivers of semi trucks (tractor trailers) meet certain qualifications. Each Oklahoma driver employed by a motor carrier (the trucking company) is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years. Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of an Oklahoma tractor trailer (semi truck) driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of an Oklahoma driver is at least 18 years old. (O.A.C. § 595:35-1-6)

b. Language:
i. English: Oklahoma semi truck drivers must be able to speak, understand, and converse in the English language.
ii. Oklahoma tractor trailer (semi truck) drivers must understand traffic signs.
iii. Oklahoma semi truck drivers must be able to make records and reports in English. (49 CFR 391.11(b)(2))

c. Operation of Oklahoma Motor Carrier (Employer):
i. Experience or training qualifies Oklahoma tractor trailer (semi truck) drivers to safely operate An Oklahoma semi truck (tractor trailer) or Oklahoma commercial vehicle. (49 CFR § 391.13)
ii. Oklahoma semi truck drivers must have the physical capability to operate motor carrier. (49 CFR § 391.41)
1. The medical aspects of driver licensing pertain only to:
(1) Class D driver license applicants or licensees,
(2) Persons operating as commercial drivers with the proper type of driver license prior to June 12, 1989, who have been continuously operating in that capacity since and wish to apply for an intrastate commercial driver license waiver, and
(3) Operators of Class A, B, or C commercial vehicles who are exempt from meeting the medical requirements as prescribed in 49 CFR § 390.3(f).  (O.A.C. § 595:10-5-4)
2. A person who is a controlled insulin-dependent diabetic may obtain a Class A, B, or C intrastate commercial driver license provided the license bears driving restriction code number six (6), "Food, fruit, or candy within reach of driver," and driving restriction code number eight (8), "Precluding the operation of a school bus or commercial vehicle transporting passengers or dangerous or hazardous materials" on the person's driver license. (O.A.C. § 595:10-5-5)

3. Standards for Class A, B, or C intrastate commercial driver license. A person with proven myocardial infarction and/or congestive heart failure, cardiac arrhythmia, or coronary insufficiency, or who experiences attacks of syncope shall not be licensed for a Class A, B, or C intrastate commercial driver license unless individually approved by the Medical Advisory Committee or its designated representative, depending upon the severity of the condition. (O.A.C. § 595:10-5-6)

4. A person may be considered for a Class A, B, or C intrastate commercial driver license if the visual acuity in one eye alone or with both eyes is twenty-forty (20/40) or better, with or without corrective lenses. A person may be considered for a Class A, B, or C intrastate commercial driver license if the field of vision is at least seventy (70) degrees in the horizontal meridian in one eye alone. (O.A.C. § 595:10-5-7)

5. Periodic medical reporting may be discontinued and the person may be considered for a Class A, B, or C intrastate commercial driver license without driving restriction code number eight (8), if the licensee submits proof from the licensee's treating physician that he or she has been:

a. free from lapses of consciousness, seizures, or epileptic episodes for two (2) years, and
b. off all anti-convulsant medication for two (2) years.
c. Multiple sclerosis. A person with multiple sclerosis shall not be licensed unless a medical report is submitted to the Department by the person's physician stating the person's limitations of visual fields, motor functions of the extremities, and coordination are not affected to a degree which renders the person unable to operate a motor vehicle safely. In addition, the person shall not be licensed for a Class A, B, or C intrastate commercial driver license unless individually approved by the Medical Advisory Committee or its designated representative, depending upon the severity of the condition. Future periodic medical reports shall be required since the disease may be progressive.
d. Parkinson's disease. A person with Parkinson's disease shall not be licensed unless a medical report is submitted to the Department by the person's physician verifying ability to operate a motor vehicle safely. In addition, the person shall not be licensed for a Class A, B, or C intrastate commercial driver license unless individually approved by the Medical Advisory Committee or its designated representative, depending upon the severity of the condition. Future periodic medical reports may be required since the disease may be progressive.
e. Cerebral palsy. A person with rigid or severe athetoid condition shall not be licensed. A person with mild spastic paraplegia and mild athetosis may be licensed provided other simultaneous difficulties, such as organic brain damage or uncontrolled convulsive disorders, are not present.
f. Progressive neuromuscular disorders. A person with progressive neuromuscular disorders, including, but not limited to, Amyotrophic Lateral Sclerosis, Friedreich's Ataxia, and muscular dystrophy, shall not be licensed until a medical report is submitted to the Department by the person's physician and individually approved by the Medical Advisory Committee or its designated representative, depending upon the severity of the condition. Future periodic medical reporting and/or driving skills reexaminations, as deemed necessary by the Department, may be required since the disease may be progressive. (O.A.C. § 595:10-5-9)
iii. All motor carriers conducting operations in intrastate commerce shall file a Motor Carrier Identification Report before commencing operations, or if already operating, as soon as practical. (O.A.C. § 595:35-1-6)
iv. Oklahoma tractor trailer (semi truck) drivers are required to reduce speed and to take into consideration bad weather conditions. An Oklahoma semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Oklahoma driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Oklahoma License:
i. Oklahoma semi truck drivers must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Oklahoma (49 CFR § 383.23(a)(2))
iii. The semi truck driver has successfully completed Oklahoma road test (49 CFR § 383.23(a))

e. Oklahoma Certifications:
i. Has any and all certifications required by Oklahoma employer / Oklahoma motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate an Oklahoma semi truck / Oklahoma motor carrier  (49 CFR § 391.15)

f. Oklahoma Driver Responsibility:
i. Hours of Service
i. No motor carrier shall permit or require any driver used by it to drive a property-carrying commercial motor vehicle, nor shall any such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or
(2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property-carrying driver complies with the provisions of Sec. 395.1(o).
(b) No motor carrier shall permit or require a driver of a property-carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after--
(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
(c)(1) Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or
(2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

ii. The following exception is added to the federal restrictions on Maximum Driving and On-Duty Time [49 CFR § 395.3(a)(1)] as required by the Act [47 O.S. § 230.15(d)]: More than eleven (11) hours following ten (10) consecutive hours off duty, except the maximum driving time within a work period is twelve (12) hours and the maximum on-duty time is fifteen (15) hours following eight (8) consecutive hours off duty if the vehicle:
a. is engaged solely in intrastate commerce, and
b. is not:
i. transporting hazardous materials which are required to be placarded or marked in accordance with 49 CFR § 177.823, or
ii. a vehicle designed to transport 15 passengers. (O.A.C. § 595:35-1-6)

iii. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

g. Truck Driver Logs
i. An Oklahoma tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Oklahoma employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations.  (49 CFR § 395.8)

ii. Driver Logs: 49 CFR § 395.8 involve An Oklahoma tractor trailer (semi truck) driver making a record of his duty status. An Oklahoma driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iii. Because of technology, the Oklahoma semi truck driver log is often kept by an on-board recording device. The log indicates when the Oklahoma driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Oklahoma motor carrier is responsible if the tractor trailer (semi truck) driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether an Oklahoma driver keeps two sets of logs or books, so that he or she could drive longer than they are allowed to drive by Oklahoma law.

iv. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

v. An Oklahoma motor carrier (the trucking company) is responsible and required to fashion or schedule their Oklahoma truck driver’s runs and routes in a way that would allow Oklahoma drivers to complete them without violating any speed limits or Hours-of-Service violations. 

vi. Oklahoma tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

h. Exceptions in the transportation of hazardous materials.
i. Cargo Tank Specifications [49 CFR § 173.33(a)], concerning the qualifications and maintenance of cargo tanks used to transport hazardous materials, shall include the following exemption: Intrastate movements of petroleum products in nonspecification cargo tanks of 3,500 gallons and less by motor carriers transporting petroleum products solely in intrastate commerce may continue, provided the cargo tanks meet the general packaging requirements of 49 CFR § 173.24, except specification packages as stated in paragraph (c), and have been in actual operation transporting similar materials prior to October 1, 1987. This provision will expire on January 1, 1999. Any retrofitting of cargo tanks after October 1, 1987 shall be made to meet specification requirements for the type of hazardous material transported in them. This exemption does not apply if at any time after October 1, 1987 the cargo tank is sold or ownership of the cargo tank is otherwise transferred. (O.A.C. § 595:35-1-6)

ii. The transportation of agricultural product other than a Class 2 material, over local roads between fields of the same farm, is excepted from the requirements of 49 CFR § § 100 through 199 when transported by a farmer who is an intrastate private motor carrier. (O.A.C. § 595:35-1-6)

iii. The transportation of an agricultural product to and from a farm, within 150 miles of the farm, is excepted from the requirements in subparts G and H of part 172 of 49 CFR § § 100 through 199 when:

1. It is transported by a farmer who is an intrastate private motor carrier.

2. The packaging conforms to the requirements of 49 CFR § 173.24 in so far as it does not leak, and the total amount of the agricultural product being transported on a single vehicle does not exceed:

a. 16,094 pounds (7,300 kilograms) of ammonium nitrate fertilizer properly classed as Division 5.1, PG III, in a bulk packaging, or
b. 502 gallons (1,900 liters), for liquids or gases, or 5,070 pounds (2,300 kilograms), for solids, of any other agricultural product.
3. Each person having any responsibility for transporting the agricultural product or preparing the product for shipment has been instructed in the applicable requirements of 49 CFR § § 100 through 199.

4. Formulated liquid agricultural products in specification packagings of 58 gallons (220 liters) or less capacity, with closures manifolded to a closed mixing system and equipped with positive dry disconnect devices, may be transported by a private motor carrier between a final distribution point and an ultimate point of application or transported for loading aboard an airplane for aerial application.

5. Pertaining to nurse tanks of anhydrous ammonia [see 49 CFR § 173.315(m)]. (O.A.C. § 595:35-1-6)

iv. Permission to drive a transport vehicle in intrastate commerce containing a hazardous material in an emergency without the proper markings or placards, as provided under Marking and Placarding Motor Vehicles [49 CFR § 177.823(a)(2)] shall be obtained from the following: Department of Public Safety, Troop S, Commercial Vehicle Enforcement Division, P. O. Box 11415, Oklahoma City, OK 73136-0415, Phone: (405) 521-6104. (O.A.C. § 595:35-1-6)

i. Alcohol and Controlled Substances
i. Alcohol and drivers of Oklahoma tractor trailers (semi trucks): A trucker cannot have any alcohol in his or her system at all while driving a tractor trailer (semi truck). This, of course, includes driving, but also when Oklahoma drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. Alcohol is not tolerated whatsoever, which is different from drivers of cars, certain vans, and motorcycles that have alcohol in their system up to certain limits, and still may be able to legally drive. The rules involving Oklahoma truck drivers are extremely strict. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

j. Truck Equipment & Repair
i. A driver of An Oklahoma tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

ii. This section of the Federal Motor Carrier Safety Regulations includes brakes to the tractor, brakes to the trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities in were a result from a collision involving a large truck.
2. It is important for regulations to be followed so that violations do not result in an Oklahoma semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iii. The Oklahoma tractor trailer (semi truck) driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

iv. An Oklahoma semi truck driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)

j. Disqualifications of Driver:

i. Oklahoma motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. (49 CFR § 391.15)
ii. Some disqualifying offenses of Oklahoma semi truck drivers include (but are not limited to):
1. Driving with a revoked or suspended license
2. Driving while under the influence of alcohol or drugs
3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)
4. Committing a felony with the use of a commercial motor vehicle (semi truck)
5. Speeding, or Reckless Driving
6. Improper and/or erratic traffic lane changes
7. Following another vehicle too closely when driving the semi truck
8. Railroad crossing violations when driving the semi truck

3. The National Network (or National Truck Network) is a network of approved state highways and interstates for semi truck (tractor trailer) drivers in the United States. The following Routes are acceptable for Oklahoma semi truck drivers:

No additional routes have been federally designated; STAA-dimensioned commercial vehicles may legally operate on all Federal-aid Primary highways under State law.

4. FALLEN CARGO:  Many Oklahoma semi truck accidents occur because cargo has fallen from the Oklahoma truck’s trailer and injured another Oklahoma motorist. Often when Oklahoma semi truck accidents occur because of fallen cargo it is a result of the Oklahoma driver not securing the cargo properly. There are certain rules that Oklahoma semi truck drivers must follow when securing cargo.

5. LAW: Oklahoma adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Oklahoma.

6. OKLAHOMA IS AN AT-FAULT STATE.

i. Oklahoma is an at-fault state: This means that the law of negligence governs motor vehicle accidents. The person who is found to be “at fault” for the accident can be held accountable for your injuries and damages in your Oklahoma semi truck accident.
ii. Uninsured Motorist Coverage: If you are injured in an Oklahoma semi truck accident, by an at-fault driver who does not have any insurance, or adequate insurance, to cover your claim, uninsured or underinsured motorist coverage may protect you in this situation.
1. Uninsured Motorist: UIM Coverage may protect you if you are involved in an Oklahoma semi truck accident with an at-fault driver who does not have ANY insurance to cover your damages.
2. Underinsured Motorist: UIM Coverage may protect you if you are involved in an Oklahoma semi truck accident with an at-fault driver who does not have ADEQUATE insurance to cover your damages.
3. Hit & Run: If you are injured in an Oklahoma semi truck accident by a hit & run driver, or the at-fault driver is not able to be identified, uninsured motorist coverage may also protect you in this situation.
iii. Statute of Limitations: 2 years
1. If you wish to commence a suit to recover damages for injuries resulting from your Oklahoma semi truck crash, you must do so within 2 years from the date of your Oklahoma semi truck accident. (12 Okl. St. § 95)
