The following law may apply to an Oregon tractor trailer, or semi truck, accident or other commercial vehicle accident. The Federal Motor Carrier Safety Regulations (FMCSR) are the rules that govern semi trucks on our highways, and have been adopted by the state of Oregon. They include rules drivers, their employers, and owners of trucks must follow.

The Federal Motor Carrier Safety Regulations that most certainly apply to any injury or death involving the negligence of a truck driver or a driver of a tractor trailer (semi trucks) or perhaps other commercial vehicles can be found at: www.fmcsa.dot.gov.  The federal law in its entirety can be found in Title 49 of the Federal Code.

OREGON TRUCKING LAW

Oregon tractor trailer, or semi truck accident law may be a little different than the federal law.  Some of the highlights are listed below.

2. OREGON SEMI TRUCK DRIVER QUALIFICATIONS:

Both Federal and Oregon state safety regulations require that Oregon drivers of semi trucks (tractor trailers) meet certain qualifications. Each Oregon driver employed by a motor carrier (the trucking company) is required to have a “driver qualification file”. This file includes the driver’s application for employment, an inquiry to previous employers for the past three years employment history, an inquiry to state agencies for the past three years for a driving record, an inquiry to state agencies annually for driving records, an annual account of the driver’s certification of violations, a certificate or equivalent for the driver’s road test, and a medical examiner’s certificate which must be renewed every two years. Other requirements that must be met include:

a. Age:
i. Interstate Travel: (traveling within 2 or more states). The required age of an Oregon tractor trailer (semi truck) driver is at least 21 years old. (49 CFR § 391.11(b)(1))
ii. Intrastate Travel: (within a single state). The required age of an Oregon driver is at least 18 years old. (Or. Admin. R. 740-100-0010)

b. Language:
i. English: Oregon semi truck drivers must be able to speak, understand, and converse in the English language.
ii. Oregon tractor trailer (semi truck) drivers must understand traffic signs.
iii. Oregon semi truck drivers must be able to make records and reports in English. (49 CFR 391.11(b)(2))

c. Operation of Oregon Motor Carrier (Employer):
i. Experience or training qualifies Oregon tractor trailer (semi truck) drivers to safely operate An Oregon semi truck (tractor trailer) or Oregon commercial vehicle. (49 CFR § 391.13)
ii. Oregon semi truck drivers must have the physical capability to operate motor carrier. (49 CFR § 391.41)
1. Notwithstanding Parts 391.41 to 391.49 (Subpart E -- Physical Qualifications and Examinations) the Department may issue a waiver of physical disqualification to a commercial vehicle driver who has met the conditions established by the Driver and Motor Vehicle Services Division. (Or. Admin. R. 740-100-0010)
iii. Oregon tractor trailer (semi truck) drivers are required to reduce speed and to take into consideration bad weather conditions. An Oregon semi truck driver must reduce speeds for snow, ice, fog, rain, smoke, dust, or other conditions that affect visibility or traction adversely. Certain conditions make it a requirement for the Oregon driver to stop their vehicle all together. (49 CFR § 392.14)

d. Valid Oregon License:
i. Oregon semi truck drivers must possess a currently valid C.D.L. (Commercial Driver’s License)
ii. The valid C.D.L. is issued by Oregon (49 CFR § 383.23(a)(2))
iii. The semi truck driver has successfully completed Oregon road test (49 CFR § 383.23(a))

e. Oregon Certifications:
i. Has any and all certifications required by Oregon employer / Oregon motor carrier (49 CFR § 391.27(c))
ii. Is not disqualified to operate an Oregon semi truck / Oregon motor carrier  (49 CFR § 391.15)

f. Oregon Driver Responsibility:
a. Hours of Service
i. No motor carrier shall permit or require any driver used by it to drive a property-carrying commercial motor vehicle, nor shall any such driver drive a property-carrying commercial motor vehicle:
(1) More than 11 cumulative hours following 10 consecutive hours off duty; or
(2) For any period after the end of the 14th hour after coming on duty following 10 consecutive hours off duty, except when a property-carrying driver complies with the provisions of Sec. 395.1(o).
(b) No motor carrier shall permit or require a driver of a property-carrying commercial motor vehicle to drive, nor shall any driver drive a property-carrying commercial motor vehicle, regardless of the number of motor carriers using the driver's services, for any period after--
(1) Having been on duty 60 hours in any 7 consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week; or
(2) Having been on duty 70 hours in any period of 8 consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week.
(c)(1) Any period of 7 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours; or
(2) Any period of 8 consecutive days may end with the beginning of any off duty period of 34 or more consecutive hours. (49 CFR § 395.3)

ii. With reference to Part 395.1(e), intrastate motor carriers transporting property may drive for a maximum of 12 hours following ten hours off duty. (Or. Admin. R. 740-100-0010)

iii. With reference to Part 395.1(g), intrastate motor carriers transporting property may drive for a maximum of 12 hours following ten hours off duty and may not drive after the 16th hour after coming on duty. (Or. Admin. R. 740-100-0010)

iv. With reference to Part 395.3, motor carriers conducting intrastate transportation of property may not require or permit any driver used by it to drive a commercial motor vehicle, nor may any such driver:
1. Exceed 12 hours driving following ten consecutive hours off-duty;

2. Drive for any period beyond the 16th hour after coming on-duty following ten consecutive hours off-duty;

3. Drive for any period following 70 hours on-duty in any seven consecutive days if the employing motor carrier does not operate commercial motor vehicles every day of the week, however, any period of seven consecutive days may end with the beginning of any off-duty period of 34 or more consecutive hours; or

4. Dive for any period following 80 hours on-duty in any eight consecutive days if the employing motor carrier operates commercial motor vehicles every day of the week, however, any period of eight consecutive days may end with the beginning of any off-duty period of 34 or more consecutive hours. (Or. Admin. R. 740-100-0010)

v. The reason for these hour restrictions is to prevent driver fatigue. It has been a proven fact that driver fatigue often is a cause of interstate trucking accidents. The trucking carrier and the driver are both responsible for this type of Hours-of-Service (HOS) violation.

g. Truck Driver Logs
i. An Oregon tractor trailer (semi truck) driver is required to keep certain specific logs to prove that he or she has not violated these Hours-of-Service rules. The Oregon employer or motor carrier is required to inspect the drivers’ logs to confirm compliance with these regulations.  (49 CFR § 395.8)

ii. Driver Logs: 49 CFR § 395.8 involve An Oregon tractor trailer (semi truck) driver making a record of his duty status. An Oregon driver must keep a log of his or her status for every 24 hour period. Pursuant to Section 395.8 of the Federal Motor Carrier Safety Regulations, the log is usually in written form and on a grid.

iii. Because of technology, the Oregon semi truck driver log is often kept by an on-board recording device. The log indicates when the Oregon driver is on and off duty and whether they are driving or in the “sleeper birth”, which is usually designated as “SB”. The Oregon motor carrier is responsible if the tractor trailer (semi truck) driver submits a false log. (49 CFR § 395.15)

1. There are sometimes investigations regarding whether an Oregon driver keeps two sets of logs or books, so that he or she could drive longer than they are allowed to drive by Oregon law.

iv. The following is an example of an Hours-of-Service truck driver log with no driving violations recorded:

 

 

v. An Oregon motor carrier (the trucking company) is responsible and required to fashion or schedule their Oregon truck driver’s runs and routes in a way that would allow Oregon drivers to complete them without violating any speed limits or Hours-of-Service violations. 

vi. Oregon tractor trailer (semi truck) drivers must follow posted speed limits. Trucks, often times, must follow a lower speed limit that drivers of cars.

h. Alcohol and Controlled Substances
i. Alcohol and drivers of Oregon tractor trailers (semi trucks): A trucker cannot have any alcohol in his or her system at all while driving a tractor trailer (semi truck). This, of course, includes driving, but also when Oregon drivers are merely “on duty”, which would include even if they were not driving, but where they are in physical control of the truck. (49 CFR § 382.201)

ii. Alcohol is not tolerated whatsoever, which is different from drivers of cars, certain vans, and motorcycles that have alcohol in their system up to certain limits, and still may be able to legally drive. The rules involving Oregon truck drivers are extremely strict. (49 CFR § 382.205)

iii. No driver shall report for duty or remain on duty when it requires the performance of safety functions, when the driver has used any controlled substance. (49 CFR § 382.213)

i. Truck Equipment & Repair
i. A driver of An Oregon tractor trailer (semi truck) must make sure that his or her truck (trailer, or cab) and its equipment are in good working order at all times. (49 CFR § 396.3(a)(1))

iii. This section of the Federal Motor Carrier Safety Regulations includes brakes to the tractor, brakes to the trailer, parking brakes, steering devices, lighting devices, tires, horn, windshield wipers, rear vision mirrors, and coupling devices (a coupling device is analog shift register, that transports analog signals or electric charges).

1. STUDIES SHOW THAT BRAKE FAILURE/DEFECTS ARE A MAJOR CAUSE IN A HIGH PERCENTAGE OF CRASHES: The National Highway Traffic Safety Administration (NHTSA) found that in 2004 there were over 400,000 big trucks that were involved in traffic crashes in the U.S. This study found that 5,190 people died and 116,000 were injured in those crashes. In 2004, one out of eight traffic fatalities in were a result from a collision involving a large truck.
2. It is important for regulations to be followed so that violations do not result in an Oregon semi truck accident. Many violations exist and will result in an accident if not inspected regularly.

iv. Requirement to Carry Chains or Traction Tires: When chains or traction tires are required to be carried and the appropriate signs are posted, chains or traction tires of sufficient size and number to comply with Division 17 rules must be in or on the vehicle. (Or. Admin. R. 740-100-0040)

v. Minimum Chains Required: When signs are posted in accordance with Division 17 rules requiring chains on all or certain classes of vehicles, chains shall be placed as described in this rule. Exhibit 1 , Minimum Chains Required, is illustrative of chain placement.

(4) Solo commercial vehicles -- vehicles with a gross vehicle weight rating of 26,001 pounds or more that are not towing:

(a) A single-drive axle solo commercial vehicle shall have chains on one tire on each side of the drive axle; and

(b) A tandem-drive axle solo commercial vehicle shall have chains on:

(A) Two tires on each side of the primary drive axle; or

(B) If both axles are powered by the drive line, on one tire on each side of each drive axle.

(5) Commercial vehicles with trailers -- vehicles with a gross vehicle weight rating of 26,001 pounds or more that are towing one or more trailers:

(a) A single-drive axle commercial vehicle towing a trailer shall have chains on two tires on each side of the drive axle and one tire on the front axle and one tire on one of the rear axles of the trailer;

(b) A single-drive axle commercial vehicle towing a semitrailer shall have chains on two tires on each side of the drive axle and two tires, one on each side, of any axle of the semitrailer;

(c) A single-drive axle commercial vehicle towing both a semitrailer and a trailer shall have chains on two tires on each side of the drive axle, two tires, one on each side, of any axle of the semitrailer, and one tire on the front axle and one tire on one of the rear axles of the trailer;

(d) A tandem-drive axle commercial vehicle towing a trailer shall have chains on two tires on each side of the primary drive axle, or if both axles of the vehicle are powered by the drive line, one tire on each side of each drive axle. Chains shall also be placed on one tire of the front axle and one tire on one of the rear axles of the trailer;

(e) A tandem-drive axle commercial vehicle towing a semitrailer shall have chains on two tires on each side of the primary drive axle; or if both axles of the vehicle are powered by the drive line, one tire on each side of each drive axle. Chains shall also be placed on two tires, one on each side, of any axle of the semitrailer;

(f) A tandem-drive axle commercial vehicle towing both a semitrailer and a trailer shall have chains on two tires on each side of the primary drive axle or if both axles of the vehicle are powered by the drive line, one tire on each side of each drive axle. Chains shall also be placed on two tires, one on each side of any axle on the semitrailer and one tire on the front axle and one tire on one of the rear axles of the trailer; and

(g) A tandem-drive axle commercial vehicle towing a semitrailer and a semitrailer that are connected by kingpin-to-fifth wheel assemblies, commonly referred to as a "B-Train," or connected by kingpin-to-fifth wheel "C-dolly" assemblies, commonly referred to as a "C-Train", shall have chains on two tires on each side of the primary drive axle; or if both axles of the vehicle are powered by the drive line, one tire on each side of each drive axle. Chains shall also be placed on two tires, one on each side, of any axle of the semitrailer at the B-train or C-train connection, and on two tires, one on each side, of any axle of the rear semitrailer. vi. The Oregon tractor trailer (semi truck) driver is responsible to make sure even their emergency medical equipment is in working order and legal at all times. The truck driver has a duty to inspect it and use it. (49 CFR § 393.95)

vii. An Oregon semi truck driver must make sure that emergency equipment is in place and ready to be used at any time. (49 CFR § 393.95)

i. Intrastate Regulations:
i. The provisions of Part 385.1(b), 385.13(b), 385.13(c), 385.13(d)(3), 385.301 through 385.337 and Appendix A to Part 385 (relating to safety fitness procedures) do not apply to a motor carrier operating exclusively in intrastate commerce. (Or. Admin. R. 740-100-0010)

ii. The provisions of Part 387 (relating to minimum levels of financial responsibility for motor carriers) shall apply to intrastate motor carriers only when transporting hazardous materials, hazardous substances or hazardous wastes. (Or. Admin. R. 740-100-0010)

iii. With reference to Part 390.21, external identification requirements do not apply to vehicles with a gross combination weight rating of 26,000 pounds or less and operated exclusively in intrastate private carriage, except those vehicles transporting hazardous materials of a type or quantity requiring placarding or passenger vehicles with a seating capacity of more than 15 passengers including the driver. (Or. Admin. R. 740-100-0010)

iv. The provisions of Parts 396.17 through 396.23 (Periodic Inspection Requirements), are not applicable to operations conducted wholly in intrastate commerce. (Or. Admin. R. 740-100-0010)

j. Private Motor Carrier Regulations: The rules in Part 391 (except Part 391.11(b)(5), Valid Operator's License, and Part 391.15, Disqualification of Drivers) do not apply to a driver who is employed by a private carrier and does not transport hazardous materials of a type or quantity requiring the vehicle to be marked or placarded in accordance with Title 49, CFR, Part 177.823, and drives a motor vehicle with a gross vehicle or gross combination weight rating of 26,000 pounds or less. (Or. Admin. R. 740-100-0010)

k. Disqualifications of Driver:

i. Oregon motor carriers, or employers or semi truck drivers, do not have the authority to disqualify a semi truck driver. Disqualifying offenses are listed in the Federal Motor Carrier Safety Regulations. (49 CFR § 391.15)
ii. Some disqualifying offenses of Oregon semi truck drivers include (but are not limited to):
1. Driving with a revoked or suspended license
2. Driving while under the influence of alcohol or drugs
3. Leaving an accident scene that involves a commercial motor vehicle (semi truck)
4. Committing a felony with the use of a commercial motor vehicle (semi truck)
5. Speeding, or Reckless Driving
6. Improper and/or erratic traffic lane changes
7. Following another vehicle too closely when driving the semi truck
8. Railroad crossing violations when driving the semi truck

4. FALLEN CARGO:  Many Oregon semi truck accidents occur because cargo has fallen from the Oregon truck’s trailer and injured another Oregon motorist. Often when Oregon semi truck accidents occur because of fallen cargo it is a result of the Oregon driver not securing the cargo properly. There are certain rules that Oregon semi truck drivers must follow when securing cargo.

5. LAW: Oregon adopts “The Federal Motor Carrier Safety Regulations”, which is Title 49 of the Federal Code, with some modifications for the state of Oregon.

6. OREGON IS AN AT-FAULT STATE.

i. Oregon is an at-fault state: This means that when you are injured in an Oregon semi truck accident, the law of negligence will govern your claim. The at-fault driver is responsible for your injuries.
ii. Uninsured Motorist Coverage: If you are injured in an Oregon semi truck accident, by an at-fault driver who does not have any insurance, or adequate insurance, to cover your claim, uninsured or underinsured motorist coverage may protect you in this situation.
1. Uninsured Motorist: UIM Coverage may protect you if you are involved in an Oregon semi truck accident with an at-fault driver who does not have ANY insurance to cover your damages.
2. Underinsured Motorist: UIM Coverage may protect you if you are involved in an Oregon semi truck accident with an at-fault driver who does not have ADEQUATE insurance to cover your damages.
3. Hit & Run: If you are injured in an Oklahoma semi truck accident by a hit & run driver, or the at-fault driver is not able to be identified, uninsured motorist coverage may also protect you in this situation.
iii. Statute of Limitations: 2 years
1. If you wish to commence a suit to recover damages for injuries resulting from your Oregon semi truck crash, you must do so within 2 years from the date of your Oregon semi truck accident. (ORS § 12.110)
12.110 Actions for certain injuries to person not arising on contract; action for overtime or premium pay; action for professional malpractice; effect of fraud or deceit; action for injuries to person arising from nuclear incident.
(1) An action for assault, battery, false imprisonment, or for any injury to the person or rights of another, not arising on contract, and not especially enumerated in this chapter, shall be commenced within two years; provided, that in an action at law based upon fraud or deceit, the limitation shall be deemed to commence only from the discovery of the fraud or deceit.
     12.115 Action for negligent injury to person or property.

(1) In no event shall any action for negligent injury to person or property of another be commenced more than 10 years from the date of the act or omission complained of.

(2) Nothing in this section shall be construed to extend any period of limitation otherwise established by law, including but not limited to the limitations established by ORS (12.110. ORS § 12.115)
